Dear Mr. Smith:
This morning I appeared before Judge Fake
on the argument of the question whether or not the statute
of limi tations is a defense. I found that Judge Fake was
about to begin the trial of an action which had been peremp-
torily set down. However, Mr. Winans insisted upon present-
ing his brief and Judge Fake said he would take it. There
was a short oral argument in which Mr. Winans in answer to
questions put by the court argued most of the points contained
in his brief. In reply I answered him at the request of
Judge Fake.
It was agreed that we were to have a week
within which to answer Mr. Winans' brief and then he was to
have the right to file a reply brief. The court said that if
Mr. Winans would call him next Monday he would fix a date for
the further oral argument of the matter.
Mr. Winans gave me a copy of his brief which
I herewith send you. He desires this returned to him when
you are through with it. I am going to file a brief and I
assume you will do likewise. I shall be glad to let you have
a copy of mine when it is ready and I shall be pleased to re-
ceive a copy of yours.
