Dear Madam
I have your letter of the 16th whi ch
I am submitting to the Radium Company without prejudice
to either your right or theirs. As soon as I receive a
reply I shall advise you.
You should also keep in mind that the
offer made was not made on the basis of any liability but
solely on the ground that the company wished to make a
voluntary payment. As I stated to you, the company feels
for numerous reasons that you have no case. The statute
of limitations has long S ince run against the claim. Other
defenses are equally as dispositive of any possible claim
that you might have. I am writing to you immediately in
response to yours so that there will be no misunderstanding
as to the position of the company in the event of litigation.
