Gentlemen:
Mr. Markley of Collins & Corbin's office wrote you relative
to the above case, sending you information developed at a conference
with Up. Laporte and his attorney on June 13th. On August 11th, we
wrote you further, relative to this subject.
During the past few days Mr. Unger, counselor at Law, who is
representing Mr. LaPorte, has been pressing us for a decision as to what
we propose to do with regard to this case, stating that his client
insists upon our indicating our dispositions, or else he will start suit
in his client's behalf.
It is our belief that this case can be settled for a rather
nominal sum, say five or six thousand dollars, and possibly less.
The evidence rather substantiates the fact that Ers. LaPorte suffered
from the effects of radium poisoning, and it is possible that it would be a
wise move to settle this case without their starting litigation..
It is our understanding from the conference held at Er. Every's
office, in December 1930, that the burden of settling any new cases would
fall to us. Be would probably be disposed to settle this case on the
condition that in the event the test case, to be made of Tuck VS. U.S.R.
Corp., as to the lisbility, was decided in favor of the U.S.R.Corp., the
cerriers covering the LaPorte onse would reimburse us for such moneys as
we had expended in the settlement of this case.
Will you kindly give this matter your consideration, and advise
us as to whether you would be disposed to agree to such & plan, which is
similar in character to the plan agreed to by you under which we settled
both the Stasi and Saxer cases.
In order to preclude suit being started in this case, we must
give them some decision in the matter.
