Gentlemen
The motion to advance the trial of the above
action was argued before Judge Dungan at the Supreme Court,
Newark, on January 22, 1932. We succeeded in having the motion
to advance the case denied.
However, we call your attention to the fact
that this case is No. 1637 on the trial calendar for the
December term, 1931 and that the court is now down to approxi-
mately case No. 500; that there are four judges hearing cases
in Essex County. If we divide the remaining 1200 cases
approximately, between the four judges, it means that each
judge will have 250 cases. At the rate the judges are pro-
ceeding this case ought to be reached for trial before July
1st of this year when the Summer vacatio sets in, so that
if the case is to be contested, steps should now be taken
to prepare it for trial.
The only insurance company on this case is
the Globe Indemnity Company. The plaintiff is now asking
$5000. in settlement. We do not think that this is the lowest
figure. We think it can be settled as low as $3000. We
recommend settlement for $3000. if better terms carnot be
secured. We make such recommendation notwithstanding that
the defense of the statute of limitations is fairly strong.
Dr. Schlundt has found the plaintiff slightly radio-active;
so has Dr. Flinn who in this case represents the plaintiff and
her attorney, Mr. Carl and counsel, Mr. Schneider.
The
latter
is an experienced trial lawyer in negligence cases and will
make the most of Dr. Flinn's testimony.
However, our recommen dation to pay $3000. is
based primarily on the fact that it will cost us $3000. or
