L AUN William D. Edwards Edwin F. Smith Edwards, Smith & Dawson Raymond Dawson No.1. Exchange Place Andrew Wittreich Charles M.James Attorneys & Counsellors at Law Jersey City,NJ. N.J. Forrest I. Smith (2035 Montgomery 2036 Edwards & Smith (2037 November 4, 1932. United States Radium Corp., 535 Pearl Street, New York City. Att: Mr. Lee. My dear Mr. Lee: You will remember we had up in the radium cases the question as to when the Statute of Limitations began to run. You will recall I have always insisted that the Statute began to run from the time of the commission of the negligent act. I enclose herewith copy of an opinion by our Court of Errors and Appeals in the case of Murray Weinstein V. Oliver R. Blanchard, in which you will note that the Court of Errors and Appeals holds that the Statute begins to run from the time of the commission of the negligent act. In other words, as affecting the United States Radium cases, it is now settled in this State that the Statute of Limitations in New Jersey would begin to run from the last day the girl worked for your Company. This does away with the contention of some of the counsel that the Statute did not begin to run until the injury began to manifest itself, or until the injured knew of the injury. EFS:RH Edevin Very J.Smith truly yours,
