Gentlemen:
Confirming our telephone conversation of
this date, I write to advise you that it is my under-
standing that you agree that the transcript of Dr. Schlund's
testimony is so defective and erroneous as to be con-
sidered by bo th sides unsatisfactory and not to be used.
I will endeavor to communicate with my
clients and witnesses in an effort to let you know whether
I can agree to your request for a continuance of the case
until October 15th, so that you may produce Dr. Schlund at
the trial.
