I have today talked to Mr. Emmerglick on
the situation relative to a postponement of the case until
around October 15, 1934 so as to insure the attendance of Dr.
Schlundt. I told him that I thought it would be wise to write
to Judge Forman, endeavoring to have the case set down for
October 15th or about that time. He said he would be agreeable
to this so far as his medical witnesses were concerned, but that
he would be under a disadvantage inasmuch as some of the girls who
are suffering, as he said, from radium poisoning might become so
sick that it might be necessary to push the trial on in September;
that he is to see them, however, and let me hear from him by
Tuesday (July 31st) as to whether or not they are in such a
position that he can consent to the case being set down for
October 15th.
As soon as I hear from him, I will inform you.
