William D. Edwards Edwin F. Smith Edwards, Smith & Dawson No.1. Exchange Place Raymond Dauson Forrest Smith Attorneys & Counsellors at Law Jensey Lity,NJ. N.J. Charles M. James Allen C. Bergen -2035 George Echelman Edwards & Smith July 27, 1934. Edward A. Markley, Esq. c/o Collins & Corbin, 1 Exchange Place, Jersey City, N. J. H.H. Barker, Esq. Vice Pres. U.S. Radium Corp., 535 Pearl Street, New York City. Re: La Porte V. U.S. Radium Corporation FAL Gentlemen: I acknowledge Mr. Barker's letter of July 23, 1934 and Mr. Markley's letter of July 24, 1934 in the above entitled matter. I note that Mr. Markley has written to Judge Forman on July 19, 1934, sending copy of his letter to me and Mr. Barker. Regarding Mr. Barker's letter of July 23rd, I had considered Mr. Emmerglick's attempt at the examination of Dr. Schlundt, and make a point of the fact that there were a large number of girls in the dial-painting room subjected (as he intimated) to the action of the quantity of radium element contained in the paste or powder being used by them, and that they were so subjected to the radio-active qualities of the radium contained in said paste or powder continuously for a long period of time, and that such might have an effect upon their physical system. I agree with Mr. Barker that we should look into this matter very carefully and that before taking any other testimony of experts, we should have a long conference with them, having in mind only the above matters, but a method of calling their attention to the various works or articles mentioned by Mr. Emmerglick. Upon my return from my vacation, I will get in touch with Mr. Markley and with Mr. Barker at once. Very truly yours, Edeven 7. Luith EFS:JB. JUL 29 1934
