Dear Barker:
In reply to your telegram advising that Mr. Emmer-
glick did not accept our deposition on account of
stenographic inaccuracy, I sent you a telegram advis-
ing that I could not possibly get away to give testimony
in court before Oct. 15. The situation here instead of
improving is attendant with new difficulties. I shall
have to be here from September 10 to October 15. I am
sorry that this is the case.
Now I have no suggestions to make but if you can
make arrangements to have another deposition taken I
shall be glad to come on, but I hope to go to Colorado
for about a week or ten days after August 18.
Please have your treausrer send us a little money
on the first shipment of mesothorium.
