Philip Forman, c/o Hotel Utah, Salt Lake City, Utah. AIR MAIL Dear Judge Forman: Mr. Edwin F. Smith of Messrs. Edwards, Smith & Dawson and myself, find that we will not be a ble to try this case before October 15, 1934. We have had Dr. Schlundt's testimony (he is one of the outstanding scientists in the radium field) taken in Jersey City last week, but due to the poor record of it made by the stenographer who was retained to transcripe the minutes, the testimony is wrthless. Dr. Schlundt cannot come to New Jersey egain until October 15th end he is absolutely essential to our case. May we therefore ask you not to fix any day for the trial of this case until you return, and also to keep in mind that October 15th is the earliest date when the case can be tried. We are sorry to break in on your vacation with matters of this kind, but this is a very important case and really is a test case for a number of others that are coming along, and involves many important questions both of law and of fact.
