August 8, 1934 Dr. S. C. Lind, Director of Chemistry, University of Minnesota, Minneapolis, Minn. Dear Dr. Lind: Due to the fact that it was impossible for Dr. Schlundt to appear at the hearing of the La Porte case during the early part of September, we requested him to come on to New York a couple of weeks ago to take his deposition. After the testimony had besn transcribed by the stenographer assigned to the case, it was so garbled that it was of little or no value to either ourselves or the plaintiffs. Re have, therefore, been endeavoring to arrange & date for this case that would be possible for Dr. Schlundt to be present. The date set at the moment is September 17th but Dr. Schlundt advised us that it will be impossible for him to come to New York prior to October 15th. We are endeavoring to have the court set a date for this case not earlier than October 15th and as soon there- after as their calendar will permit. On account of the court being on vacation in the West, we probably will not have & definite date set until the first week in September. In the meantine I should like to have you give us information as to your availability on or about October 15th. We assume that you could be available during the week of September 17th.
