As per my talk with you yesterday morn-
ing, we should have a representative present at Newark at
the opening call of the equity calendar at the U. S. District
Court for the purpose of answering the call of the above rad-
ium cases. These cases should not be set for hearing until
after Judge Forman decides the equity case of LaPorte vs.
U. S. Radium Corp. which is specially set for about October
15th, next. In that case, Mr. Emmerglick appears for Mr. Unger,
attorney of record. He also appears in the Shay case supra.
The Connolley case is in the hands of Schneider & Schneider
and the Lohnfinke case is in the hands of Holmwood & Greighton.
These lawyers, undoubtedly, will not be ready and they will
probably grasp at our excuse supra for getting these cases
over. Our representative should, therefore, urge the Court
to mark these cases as awaiting the outcome in the LaPorte
oase because the LaPorte case is a test case and involves
the identical issues that are involved in the above cases
and probably the decision in the LePorte case will do away
with the necessity of having final hearings in the above
cases.
I should like to have á report in writing
on September 11th as to just how the cases are marked.
