COLLINS & CORBIN COUNSELLORS AT LAW CLEMENT K. CORBIN ROBERT J. BAIN EDWARD A. MARKLEY CHARLES W. BROADHURST 1 EXCHANGE PLACE, HOWARD F. MC INTYRE JAMES B. EMORY JERSEY CITY, N.J. PATRICK F. MC DEVITT JOHN F. LEONARD JAMES J. LANGAN ADOLPH S. HUMMEL September 11, 1934. CHARLES H. SCHAFER ENOS A. PYLE RAYMOND J. LAMB EARLE J. HARRINGTON Re: La Porte vs. U. S. Radium. Edwin F. Smith, Esq., 1 Exchange Place, Jersey City, N.J. Howard H. Barker, Esq., Vice Pres., U. S. Radium Co., 535 Pearl St., New York City. Dear Sirs: I have a letter from Mr. Emmerglick, counsel for the plaintiff in the above, wherein he states that he will consent to an adjournment of the final hearing of the equity suit until October 15th, but only upon the express condition that it meets with Judge Forman's approval, and second, that if for any reason either Dr. Schlundt or Dr. Lind cannot be present on the 15th, we will arrange to take their testimony in advance, or else proceed with the case without their testimony. In view of the fact that the matter has been adjourned repeatedly, I am quite sure that Judge Forman will impose such terms, and I am merely calling them to your attention, so that they may be a matter of record. Yours very truly, EAM:GM SEP 12 1934
