COLLINS & CORBIN COUNSELLORS AT LAW CLEMENT K. CORBIN ROBERT J. BAIN EDWARD A. MARKLEY CHARLES W. BROADHURST 1 EXCHANGE PLACE, HOWARD F. MC INTYRE JAMES B. EMORY JERSEY CITY, N. J. PATRICK F. MC DEVITT JOHN F. LEONARD JAMES J. LANGAN ADOLPH S. HUMMEL CHARLES H. SCHAFER ENOS A. PYLE RAYMOND J. LAMB EARLE J. HARRINGTON February 6, 1935. La Porte V. U. S. Radium Corp. H. H. Barker, Esq., Vice Pres., United States Radium Corp., 535 Pearl Street, New York City. Dear Mr. Barker: Herewith bill of Therese Cross Bergen for $228.37 for volume 1 consisting of 406 pages of the minutes of the trial. There will be a number of additional volumes of course, as this testimony only takes in a very small portion of Dr. May's testimony and the rest of the volume is taken up with the lay witnesses produced by the plaintiff prior to the time that Dr. May was called. We have only ordered one complete copy of the minutes. This means that we will have to copy from the volumes as they are given to us in order to provide additional copies. You will note that the rate charged in the enclosed bill is 25c per folio for the court's copy which is the original copy, of which each side pays one-half and then we are charged 10c a folio for the copy of the record. I have inquired of Mrs. Bergen and Mrs. Gulliver what the rate would be per folio for two additional copies so as to complete that part already received by Mr. Smith and myself. As soon as I have word I shall send it along. I shall also watch these bills as they come in to see whether we are receiving credit for the testimony already transcribed. As far as volume 1 is concerned we are entitled to no credit except for a small portion of Dr. May's testimony therein contained and undoubtedly the credit for what we paid for his testimony during the trial will come in a subsequent bill. Yours very truly, EAM: AG FEB7 1935
