Dear Mr. Barker:
I understand in the above matters that the New Amsterdam
and the Aetna Life Insurance Company have disclaimed, but that
there is some question whether the Globe Indemnity is disclaiming.
I spoke to Mr. Gray today and he said that he was not clear
just what the position of his company would be and that he was await-
ing final instructions from Mr. Henderson which he expected to have
within a day or two.
From my talk with you today, I further understand that you
wish me to undertake the defense of these cases for your company
until such time as it may be determined that the insurance companies
are obligated to defend. If you will send me the original summonses
and complaints, I shall immediately enter the appearance of my firm
and take such further proceedings as may be necessary to protect
your company's interests.
