Dear Mr. Barker:
Mr. Studer of Messrs. McCarter & English called on the
19th inst. and stated that the American Mutual had sent the
summonses and complaints to him in the above two cases and that he
wished to advise me that the company's position would be consistent
with its previous stand that it would refuse to defend. However,
he said there might be some delay in advising you of the fact as
Mr. Brooks of the Company was away.
He wanted to know whether in the meantime your company's
interests would be protected and I told him that I was protecting
your interest until his company decided whether it would come in
and defend, if it did so decide. Of course if it did not decide
to defend, I presume that If Judge Ackerson's decision should be
adverse, his company will have to stand its portion of the liability, which
statment Mr. Studer agreed with.
