C & C 1539 Burricelli V. U. S. Radium Corp.
1. Mr. Emmerglick says that the plaintiff was
examined by Dr. Martland who is interested in the case. That
is the reason why he has taken it. Plaintiff has had three
pieces of bone taken out of her head. These have been
examined for radio-activity by Dr. Martland and he has found
plaintiff radio-active.
2. Emmerglick is willing to have Dr. Flinn
make the general tests for radio-activity. This can be done
at Dr. Martland's office in the Newark City Laboratory. We
will probably have to ask Dr. Martland's consent, however.
We should also have a general practitioner like Dr. Brothers
make a complete physical examination. It may be we also want
to take some X-rays, although probably Dr. Martland has had
X-rays taken and we can examine those.
3. Emmerglick says that he heard that Judge
Forman has practically finished his opinion in the La Porte
case and that he, Emmerglick, has arranged for financing of
an appeal in the event that the decision is adverse to him.
He is not sure, however, that he will be successful in financ-
ing the appeal.
4. We have twenty days or until October 21, 1935
in which to answer or otherwise move with respect to the
equity complaint.
5. None of the insurance companies have
answered the Radium Company's letter re institution of equity
suit and it must therefore be assumed that they all deny
liability, as they did with respect to the law action.
