Going back to 1980, thore was no knowledge that an
hazard existed In disl painting. Thether or not it oould have been
establisher is the radium exports had put thenselves to the
task, is a mitter of conjecture. Medicol and soientific opinion con-
cerning radium was going through changes, slow in process, which were
the result of an increasing number of experiments. Thoze is nothing
on which a finding of negligenco, in failing to discover the dangora
in the industry, could be based.
There is another serious question which should be briefly 001-
a Mered but the docision of the court makon it unnecessary to doter-
mino it. It is that of whether or not the conduet of the docedent
and the successors to her alleged esuse of action constituted laches
which would prevent the plaintiff from enjoining the defense of the
statute of limitetions, even 1f the defendent was guilty of equitable
Traud.
It should bo zecemberod that the defendent was unaware of the
decedent's existonoe after 1920; that the degedent firmly believed
during 1987 that she was a viotim of rndium poisoning; that, in fact,
ahe hed the common symptoms of the disease experienced by other cases
with whom she frequently associated; that ahe had had X-rays talcon
in 1925 which Dr. Martland road in 1930 as showing typical eroan of
radistion osteitis in her Jawbone, that aftor 1937 she attended
dentists and a physician and rolated her Toars to thera but was re-
assured by them; that ahe continued to suffer from the monifestations
of the disease; that on Oetober 15, 1930, Dr. Martland diagnosed
