Howard H. Barker, Esq., Vice Pres., U. S. Radium Corp., 535 Pearl Street, New York City. Dear Mr. Barker: I had a conference today with Mr. Peer of the firm of Messrs. Peer & Mahr who represent the plaintiff in this action. He desired to know whether we would pay anything in settlement. He informed me that he was not sure that his client would be bound by the decision in the La Porte case and that an appeal might be taken in the La Porte case as Mr. Emmerglick and all the counsel in that case have conferred with the other lawyers involved in these cases to see whether funds could be raised to prosecute an appeal. I am making a report to you under separate cover in the La Porte case. In view of the victory in the La Porte case it is my recommendation that in the Sullivan case we should refuse to make any payment in settlement. We of course would consent to a discontinuance without costs. The strong probability is that the plaintiff will not be able to pay the costs in any event.
