Radina Purmant to the conference held on Friday, December 27th, 1935 in Judge Formen's chaubera, at Trentoa, N.J. relative to saiting payments to är. Unger and lif. for expenditures incurred by lir. Unger and payment for legal serviere of morglick in behnif of the plaintiff. This subject hna been discussed with our Board, and while in principle they do not deem the procedure indiested, nevortholess wa are horowith authorizing you to acvise the Court that we will ecte tribute our ahare, manely $2,000. on the condition that the Insurace Companica contribute thoir shares, es specified by Judge Forman. Es wish to further point out that se are mazing this payment only at the request of Judge Porani, and that sace cust be usde in such a demner that se shonld not be accused of negptiating with the plaintifit's attorney to the end thet be would not appanl the present case end discontino other cases mhero he is the comasel of regord or associeted counsol. As pointed out by the Gourts, the payaent, hosever, is being ando with the distinct understanding that thero will nd be an appoal asde in the above referred to case end that Equergliek will recom- nond the discontinuanee of other suits in vhich be is the counsel of record, or in such casos where be is associated commel, and his edvice will be followed. lie sholl andit your advice as to tho millingness of your respective Insurance Companies to contribute their indicated shares and netbod of payment.
