Re: LaPorte vs. U.S. Radium Corp.
Gentlemen:
Pursuant to the conference held on Friday, December
27th, 1935 in Judge Forman's chambers, at Trenton, N.J. relative
to making payments to Mr. Unger and Mr. Emmerglick for expenditures
incurred by Mr. Unger and payment for legal services of Mr. Em-
merglick in behalf of the plaintiff.
This subject has been discussed with our Board, and while
in principle they do not deem the procedure indicated, nevertheless
we are herewith authorizing you to advise the Court that we will con-
tribute our share, namely $2,000. on the condition that the Insurance
Companies contribute their shares, as specified by Judge Forman. We
wish to further point out that we are making this payment only at the
request of Judge Forman, and that same mist be made in such a manner
that we should not be accused of negotiating with the plaintiff's
attorney to the end that he would not appeal the present case and
discontinue other cases where he is the counsel of record or associated
counsel. As pointed out by the Court, the payment, however, is being
made with the distinct understanding that there will not be an appeal
made in the above referred to case and that Mr. Emmerglick will recom-
mend the discontinuance of other suits in which he is the counsel of
record, or in such cases where he is associated counsel and his advice
will be followed.
We shall await your advice as to the willingness of your
respective Insurane Companies to centribute their indicated shares
and method of payment. The question is raised as to whether or not it
is advisable to have this payment stipulated in the order for dis-
missing the bill, and here again we will be governed by your advice.
