Dear Judge Formen:
Replying to your letter of the 19th, please
be advised that on the 84th I received word from the Globe
Indemnity Company that 10 would not pay anything to Mr.
Emerglick for various reasons, but primarily because there
was no liability for any coverage and because the Company had
already paid out & very considerable our of money on the
radium litigation® when in fact there was no coverage.
The offer of the Now Ameterdem Camalty Company
represented by Hr. Smith, to pay $1000. was conditionsd upon
the Globe paying $1000. and the offer of the Radium Company
was conditioned upon both of the insurance compenies paying
something.
I immediately gave 10th Emerglick this informa-
tion and he stated that he gave me informal notice over the
telephone that he would appear before you next Friday at two
o'clock subject to an engagement I have before Judge Ackerson,
and provided of course that engagement which is in the morning
at ten o'clock will be finished by two, for the purpose of
finally settling this phase of the mtter.
In the meantime I an taking the matter up with
the Radium Company and with Nr. Smith or the New Amsterdam
to find out whether they care to make any contribution, even
though the Globe does not.
