Radium Corp., 535 Pearl Street, New York City. Dear C.B. I was speaking to Mr. Gray today and he informs me that Mr. Unger for whom Mr. Emmerglick appeared, had offered to take $500. from the Globe. This indicates that Messrs. Emmerglick and Unger would probably take your $2000. if they could not do any better. As I stated to you over the telephone, it is my opinion that Judge Forman has no legal right to make an award to Mr. Emmerglick. He decided in our favor not because he wanted to but because he was compelled to in view of the conclusions he arrived at on the law and the facts. Also, I doubt whether he would make an award which was not consented to, although he might. After giving the matter very thoughtful considera- tion, It seems to me that we could very well take the posi tion that no award of any kind should be made and that your com- pany does not want to pay anything because it feels that legally no award should be made. If it were my money, that would be my position. In short, I do not think that you ought to pay even the $2000. since there is no legal obligation to pay. If, however, your company wishes to pay its $2000. not- withstanding that the insurance companies will not pay any- thing, that is a matter of policy and not a matter of law for me to decide.
