United States District Court District of New Jersey Ethelwyne Metz (nee Peer) and : Edward Metz, her husband : : Plaintiffs : : In Equity vs. : : United States Radium Corporation : ORDER DISMISSING BILL OF a corporation of the State of : COMPLAINT Delaware : : Defendant. : UTA c/s YAM A motion to dismiss the Bill of complaint in the above stated cause having come on to be heard pursuant to notice duly served, in the presence of the solicitors of the defendant, no one appearing on the part of the complainent in opposition thereto, and it appearing to the court that no steps have been taken therein since September 1, 1933. It is on this 23rd day of May 1936, ORDERED that the bill of complaint be and it hereby is dismissed for failure to prosecute with costs to defendnat.
