My dear Vice Chancellor,
We have given careful consideration to
the suggestion which you made on the 22nd inst. ,
which we understand as follows: That we rest our
case for the sole purpose of securing a determina-
tion whether the actions at law of the complainants
are barred by the Statute of Limitations ; that
you will then hear argument upon this question and
that if you conclude that the actions are not barred
by the Statute the bills of complaint will be dis-
missed.
We feel that we shoul d no adopt this
suggestion for the following reasons:
First. Our client has been charged with a
serious fraud and as yet has had no opportunity to
produce evidence which refutes such charge.
