COUNSELLORS AT LAW
1 Exchange Place,
Jersey City, N.J.
C & C 1461 Anita Burcelli vs. U.S. Radium Corp.
Harold J. Weber; Estate of Touie C. Hanle
Weber vs. U.S. Radium Corp.
C. B. Lee, Esq.,
Pres. United States Radium Co.,
535 Pearl Street,
New York City.
Dear Mr. Lee:
Replying further to your letter of the 3rd, please be
advised that Mr. Chas. Stockdell Gray for the Globe Indemnity Company,
requests me to write you stating that his company feels that it is under
no obligation to provide any further defense of any kind in any one of
these occupational disease cases, in view of the decision of Judge
Ackerson in United States Radium vs. Globe, Aetna, et al. He is willing
to receive from time to time advices as to whatis transpiring, if you
care to send such information, but it must be with the distinct under-
standing that there is a complete reservation of all rights of coverage
and that the Globe Indemnity Company at this time disclaims any liability
and further, refuses to give any defense.
Of course, if Judge Ackerson's decision should be reversed by
the Court of Appeals and it should be held by that Court that there is
coverage, then from that point on, the Globe Indemnity Company would be
willing to give the matter further consideration.
Wit h kindest regards,
Sincerely yours,
EAM: AG
