I've modified the Pelosi text to drop the explicit dollar amount
and replace it with "sufficient funding as determined...."
Notwithstanding any other provision of law, of the amounts made
available for the National Institutes of Health in Public Law
104-91, sufficient funding as determined by the Director of the
National Institutes of Health shall be available to the Office of
AIDS Research for carrying out part D of Title XXIII of the Public
Health Service Act; Provided, That the Director of the Office of
AIDS Research shall transfer from this appropriation the amounts
necesary to carry out section 2353 (d) of the Act.
I spoke with Winnie. She had not drafted any language. We
discussed the concept of saying something like 'sufficient funding
as determined.. She seemed to think it would be ok, and better
than the Senate language (which is better than the House
language).
She wanted to talk with some in the community to see what they
thought, since she can't speak for the whole community. I said ok
ONLY if she presented it as her idea and didn't mention me, the
Administration, etc. -- since I was only fooling around with
language and had not even shared it with you yet. She said fine
-- she would present it as a concept of hers, and not mention the
executive branch. She said that if you approve the language or
some variant, that that would be helpful to know at some point.
She'll call me back in the morning unless she can get a quick read
tonight, in which case she may call you this evening. The main
question she will be working with the community is whether it is
better to seek compromise language like this or continue to press
for unadulterated Pelosi language.

Good news: We got the word back that it's ok to give the Keystone Center the go
ahead. However, the VP and the Chief of Staff want our office to have some
sort of role in the process. Do you have a name and number of someone at the
Keystone Center that I could speak with about involving (in a limited way)
Greg/Skila in the process? Thanks.
Also,I want to make sure the Keystone Center takes into account the suggestions
we had re: their proposal (inviting doctors, providing in it's final report
several suggested solutions to the post-marketing trials problem; including
funding and that they would consider the VP 4-part collaboration suggestion).
Should I include this in the letter from the VP?

State Arrival Ceremony for Italy
The President and Mrs. Clinton are pleased to invite all EOP
Passholders, and two guests each, to the State Arrival Ceremony
for President Oscar Luigi Scalfaro of Italy on Tuesday, April 2,
1996 at 10:00 a.m.
Please review the following information:
EOP passholders, with hard passes that display the passholder
picture, may attend if their pass is one of the following types:
CONTRACTOR, E/EOB, MAC, MIL, NEOB, NGS, OGA, RES, SE, U, and W.
Sorry, other pass types, or those whose pass does not have their
photo, are not able to attend.
Passholders enter their guests' names through OASIS. From your
main "All-In-1" screen select "DM" and then "ACA", and enter
names as instructed. The deadline is 3:00 p.m. Wednesday, March
27. Passholders who do not have access to OASIS will receive a
memo from the Visitors Office for other arrangements.
Passholders must pick up their guest's tickets in the OEOB
Pennsylvania Avenue lobby on Friday, March 29 between 4:00 and
5:00pm.
Passholders and their guests enter the South Lawn using the
Southwest gate between 8:30am and 9:30am on the morning of the
Arrival. The gate closes promptly at 9:30am. No one is
admitted after that time.

The recent approval of costly new AIDS drugs, which could
raise the cost of treating HIV from $2,500 a year to $12,000,
leaves cities and states in the difficult position of trying to
devise ways to help pay for them. In the face of federal
government spending shortfalls, Maryland Gov. Parris Glendening
has promised about $1 million in additional state funds to pay
for the new drugs. In addition, the Clinton administration has
asked Congress to approve an extra $52 million for drug payment
programs, but the request has been stymied by the budget debate.
Scientists hope the new drugs will allow HIV-infected
individuals to live longer, more productive lives.

Since finding out in 1992 that she has HIV, Lisa Tiger has
become an AIDS activist in the American Indian community, sharing
her story and telling others that anyone can get AIDS, including
people like her from the rural middle class. The Centers for
Disease Control and Prevention estimates that as of June 1995,
1,010 American Indians had AIDS, but people like Tiger and Miguel
Marinez of the National Native American AIDS Prevention Center
claim the figure is too low. Daniel Simpson, an AIDS coordinator
for the Indian Health Service, says the infection rate is
underreported because AIDS is a taboo subject in the American
Indian community.

Auto racer Tim Richmond infected several women with HIV
before he died in 1989, according to the Miami Herald.
Richmond's former fiancee, LaGena Lookabill Greene, announced
last year that she had AIDS and that she was infected by
Richmond. The Herald reported that two other of Richmond's
partners also have AIDS and that another one has died.

For the first time, a preventive AIDS vaccine made with HIV
DNA will be tested in uninfected people. The vaccine, made by
Apollon Inc. and the University of Pennsylvania, will be given to
16 HIV-negative volunteers who will be followed for 18 months to
determine the vaccine's safety and efficacy. The vaccine's two
parts--one containing the genes for the production of key HIV
proteins and the other containing genes to make viral core
proteins, will be tested separately. Also, a DNA-based
Apollon-Penn vaccine designed to delay the onset of AIDS is now
being tested in HIV-infected individuals.

Researchers have found several compounds that may be used as
vaginal microbicides for preventing HIV infection. Dr. Rudi
Pauwels of the Institute for Antiviral Research in Belgium and
colleagues report that little attention has been given to the
chemical prevention of HIV infection and that spermicides with
HIV-inactivating action may have promise to block heterosexual
HIV transmission. Nonoxynol 9 and chlorhexidine are two
virucidals being studied, and compounds that target other steps
in the viral replication cycle could be valuable as secondary
barriers.

Dr. Max Essex, chairman of the Harvard AIDS Institute, warns
that the United States may be facing a second AIDS epidemic.
HIV-1B, the common HIV type in the United States and Europe, is
transmitted through injection drug use, blood products and
primary homosexual contact. HIV-1C, -E, -D, and -A subtypes,
especially HIV-1C and HIV-E, are currently spreading rapidly in
Southeast Asia and Africa. Essex says that these non-B strains
are transmitted primarily through vaginal intercourse, and are a
greater threat to the world's population. Furthermore, he says
that if they took hold in the United States or Europe, they could
cause "a heterosexual epidemic of significantly greater
magnitude."

Tuberculosis (TB) remains a public health problem in much of
Latin America and the Caribbean, killing more than 70,000 people
in 1995, the Pan-American Health Organization (PAHO) reported
Friday. Of all the TB-related deaths in the Western Hemisphere
last year, 95 percent were in Latin America and the Caribbean.
The countries with the worst epidemics include Bolivia, Peru, the
Dominican Republic, and Ecuador. PAHO estimates that less
than 70 percent of the TB patients receive complete treatment,
increasing the likelihood of resistant TB strains developing. A
PAHO official said that even poor countries can fight the
epidemic with consistent treatment, citing Peru and Nicaragua as
examples.

Health Resources and Services Administration (03/22/96)
The Health Resources and Services Administration (HRSA)
announced Friday that it has provided its service providers with
information about offering therapy for HIV-infected pregnant
women to reduce viral transmission to their infants. "Program
Advisory: Use of Zidovudine (ZDV) to Reduce Perinatal HIV
Transmission in HRSA-Funded Programs" offers useful strategies
and options for helping women to make practical decisions about
ZDV treatment. Included in the 30-page document is a model form
to document provider counseling, patient choice for
administration of the ZDV therapy, and previous suggestions from
the U.S. Public Health Service concerning HIV testing and
counseling for infected pregnant women and ZDV use. HRSA
Administrator Ciro V. Sumaya said, "We must ensure that women are
fully informed and understand that the decision is ultimately
theirs." According to HRSA, which works with thousands of health
care providers in such programs as the Community and Migrant
Health Centers and the Ryan White CARE Act, the guidance should
represent the standard of care for pregnant women and be followed
in all programs funded by the agency.

Patients in clinical studies develop resistance to
lamivudine (3TC) after 12 weeks of monotherapy, but do well
regardless. This could be because the resistant strain appears
at the same time immunity against viral replication develops.
Vinayaka Prasad of Albert Einstein College of Medicine and Mark
Wainberg of McGill University conducted a study with the M184V
strain, which can be 1,000 times more resistant than the
wild-type virus to 3TC. The researchers found that HIV
antibodies decreased seven times faster in zidovudine-treated
patients than they did in patients treated with 3TC. This
suggests that the M184V strain may have prevented the emergence
of strains that help the virus escape attack by antibodies. The
researchers also found that when the strain was grown in the
presence of anti-HIV agents, it prevented the emergence of
variants that were resistant to them.

research with each purchase they make. A percentage of all

He has asked me to come to lunch in New York this Friday at 12:30;
I asked him to please allow me to include two additional people
which he has had his assistant to change the reservation to
accommodate. I need for (a) Skila or Greg and (b) Patsy or Jeff to

I understand that you will be meeting with Ellen Weber of the
Legal Action Center regarding the proposed policy for use of Ryan
White funds for substance abuse treatment. I hope that you will
be able to be responsive to her concerns; as you know, the
President has highlighted the linkage of HIV and substance abuse
as a key priority for the Administration's response to the
epidemic.
I have known Ellen for a number of years; the Legal Action Center
has been at the forefront of the substance abuse community's
response to the HIV epidemic. I hope you will come to include LAC
in your consultations on policies -- preferably prior to their
development so that HRSA can take advantage of the experience and
expertise they have.

first commercial life insurance policy for people with HIV. At
least 1.5 million South Africans have the virus, though 80 percent
have not developed AIDS. Industry observers note that the plateau
of HIV infection in developed countries could deter insurers in the
west from developing similar policies. MetLife's coverage is
limited to people aged 15 to 55 who are in the asymptomatic
stages of HIV infection. The maximum death benefit is $12,800.

NeXstar Pharmaceuticals Inc., of Boulder, CO, announced that
Germany, the Netherlands, Finland, and Norway have cleared
DaunoXome, the company's new drug for Kaposi's sarcoma, for
marketing. NeXstar said it would begin selling the drug in Germany
and the Netherlands within the next few weeks and that its
marketing partner in the Nordic countries would handle the drug's
sales in Finland and Norway. The drug was previously approved in
Sweden and the United Kingdom.

In a Wall Street Journal editorial, the authors urge the
support of an amendment to the Ryan White Care Reauthorization Act
that would require mandatory HIV testing of babies born to mothers
who were not tested. Members of a House-Senate conference
committee are scheduled to work on the legislation on Tuesday.
Studies have shown that mothers with HIV who take AZT during
pregnancy lessen the chance of infecting their infants by
two-thirds. Still, many mothers at risk for HIV are not tested or
treated; then, their babies are born with HIV and also often go
untreated. AIDS activists and feminist groups have opposed
mandatory testing of newborns, arguing that it infringes on the
mother's privacy. The authors note, however, that if the Ryan
White CARE Act is reauthorized without the Ackerman-Coburn
provision, HIV-positive infants will not be included in a measure
whose title carries the name of a child that died from the disease.

In a letter to the editor in the Philadelphia Inquirer, David
Gary Smith, a physician at Abington Memorial Hospital, points out
that mandatory HIV testing of pregnant women could keep women at
risk from getting proper prenatal care. While studies have
estimated that counseling women about being tested for HIV can
reduce HIV transmission to newborns by 66 percent, inadequate
mandatory testing, Smith says, could also have a negative impact.
Smith further notes that Philadelphia's health commissioner,
Estelle B. Richman, has led the way for maximizing the benefits of
testing and minimizing the risks of a health-care intervention by
forming an advisory board, which in December stressed the need
for effective outreach and counseling for pregnant women.
"AIDS Conference Adopts Hopeful Spirit"

AIDS Researchers and health workers say the 11th International
Conference on AIDS, to be held in Vancouver, British Columbia,
will be optimistic and hopeful. "The mood among this group is
that we are taking our understanding of the virus and its effects
to unprecedented and exciting new levels," said Vancouver
researcher Michael O'Shaughnessy. The conference will be held
July 7 to 12 and is expected to be the most significant event of
the year for researchers studying HIV.
"Experimental AIDS Vaccine Volunteer Infected"

One of 24 volunteers participating in a test of an
experimental AIDS vaccine developed by United Biomedical Inc. of
Hauppauge, NY, has been infected with HIV. Dr. James Kahn of the
University of California, San Francisco, reports that the
individual who was infected had received four doses of the
vaccine; however, the vaccine is not thought to be the source of
infection because it does not contain live virus. Khan notes the
trial was designed to assess the vaccine's safety, not its
efficacy.
"Anti-HIV Agent Inhibits Early Step in HIV Life Cycle"

Researchers at Sandoz in Austria and SyStemix Inc. in Palo
Alto report promising results with an experimental anti-HIV
compound called SID 791. SID 791 is a bicyclam, which inhibits an
early step in the life cycle of HIV, presumably a step associated
with the virus' entry into cells. Experiments in mice suggest that
the compound alone, or in combination with other antivirals, could
decrease the viral load in HIV-infected patients, and that HIV
therapy should target the virus' entry into the cell.
"Thalidomide: Facilitates Weight Gain in Persons with HIV and M.

Thalidomide may help people with HIV and other infections gain
weight, researchers at New York University Medical Center and
Rockefeller University report. Gilla Kaplan of Rockefeller
University led the study of 32 patients with HIV-1, some of whom
also had tuberculosis. Kaplan says that tumor necrosis
factor-alpha is made by the body to defend against infection, but
it may also cause fever, weakness, and wasting. Thalidomide,
which is known to inhibit the synthesis of TNG-alpha, might
prevent continued wasting, and even help patients gain weight,
the researchers surmised.
"Persistent Lack of Detectable HIV-1 Antibody in a Person with

Morbidity and Mortality Weekly Report (03/08/96) Vol. 45, No. 9,
P. 181; Reimer, L.; Brokopp, C.; Mottice, S.; et al.
Last year, a patient in Utah was found to be infected with HIV
even though he tested negative for the HIV-antibody beyond the
expected "window period." The patient--who experienced fatigue,
weight loss, and a respiratory illness--had frequently donated
plasma, and each donation was also negative for the antibody.
However, his wife, who had sexual contact with a man who later
died of AIDS, tested positive for HIV. The patient said he had
not used injection drugs, had a transfusion, or had male-to-male
sexual contact. Blood samples from the patient were analyzed by
the Centers for Disease Control and Prevention and the Food and
Drug Administration. Several test kits were used, and while some
showed no reaction, some showed a weak reaction, and a test for
HIV-1 p24 antigen showed positive results. An editorial
accompanying the report says that the man probably was infected
by his wife and that the negative tests were probably a result of
an atypical host response to the virus--an occurrence which has
been reported in a small number of patients before.
"Pregnant Nurse Won't Treat HIV Patient"
American Medical News (03/04/96) Vol. 39, No. 9, P. 22
A federal appellate court in Alabama has affirmed summary
judgment of a hospital sued for discrimination by a pregnant
nurse who refused to treat an HIV-positive patient. The nurse,
who was in her first trimester of pregnancy, refused to treat a
cryptococcal meningitis patient who was HIV-positive. She was
especially concerned about contracting one of the opportunistic
diseases associated with HIV because she had gestational diabetes
and was immunocompromised. The nurse--who was fired for her
decision, but resigned before the termination took effect--sued
the hospital four months later when she learned that it had not
assumed payment of her student loans, which was part of her
employment contract. The hospital was granted partial summary
judgment, which the nurse appealed and the appellate court
affirmed. The court held that the nurse failed to establish a
prima facie case of discrimination. She did not show that
hospital rules allowed a pregnant nurse to refuse to treat an
HIV-positive patient or that the hospital policy concerning
patients with HIV resulted in disproportionate impact on pregnant
nurses.

On Thursday, July 13th, the Institute of Medicine will be
releasing its report HIV and the Blood Supply: An Analysis of
Crisis Decisionmaking." It assesses the federal government's
response to the emerging threat of transmission of HIV through
blood and blood products during the period 1982
-1986. To date,
according to the report, over 12,000 blood transfusion recipients
and about half of the nation's 16,000 hemophiliacs contracted HIV
from the blood supply.
This has been a very emotional issue throughout the epidemic. It
has been the focus, in recent years, of a good deal of activity
from the hemophilia community including class action suits and
the introduction of legislation by Rep. Peter Goss of Florida to
create a compensation fund ($125,000 per person) for those who
were infected with HIV by blood products. The legislation is
named for Ricky Ray, one of the individuals cited by the
President in his speech last week.
It should be noted that the risk of HIV transmission through
blood and blood products is extremely low (1 in 450,000) with the
implementation of screening for HIV itself in 1984. According to
HHS, there are no known cases of transfusion
-associated HIV
transmission since 1987 (although the latency period between
infection and disease has not closed yet).
The IOM Committee's conclusions can be summarized by their belief
"that a failure of leadership may have delayed effective action
during the period from 1982 to 1984. This failure led to less
than effective donor screening, weak regulatory actions, and
insufficient communication to patients about the risks of AIDS."
Findings of the IOM Committee
Among the findings of the Committee are:
? The Public Health Service failed to respond aggressively to the
crisis, even after it was clear that HIV could be transmitted
through blood and blood products. At critical junctures, PHS
leadership took the least controversial route to avoid criticism
and the FDA failed to adequately exercise its regulatory powers.
? The PHS and FDA advisory processes were too dominated by the
blood industry to afford objective consideration of the evidence.

concerns. (The National Hemophilia Foundation is also strongly
criticized for not taking the threat seriously enough and being
influenced by financial support from the blood industry.)
? The PHS is also criticized for not adequately coordinating its
response among the various agencies. The CDC, for example, issued
strong warnings about taking stronger steps to protect the blood
supply, but these were not heeded -- nor were dissenters required
to respond to their concerns systematically.
? The ultimate failure was that PHS did not mandate or move
quickly enough on three interventions that might have better
protected the blood supply:
(1) Rapid implementation of heat treatment of factor VIII (the
blood product used by hemophiliacs). Heat treatment kills HIV
and is now standard practice.
(2) FDA requiring aggressive donor screening. The IOM Committee
feels that "political pressure" from the gay community prevented
the blood industry and the FDA from requiring more aggressive
screening out of homosexuals from donating blood. (There are
some historical inaccuracies here: In fact, the gay community in
New York worked closely with the New York Blood Center to develop
a screening mechanism that urged those at risk to mark their
donation for "research purposes" -- therefore not requiring
"outing" of individuals who were donating blood but still at
removing those individuals from the donor pools. This turned out
(from retrospective studies) to be quite successful; however, it
was not widely adopted.)
(3) FDA should have required surrogate marker screening of the
blood -- specifically hepatitis B testing. This was rejected as
too expensive and perhaps threatening the adequacy of the blood
supply by the industry. Hepatitis testing of donations should
have occurred well before the HIV epidemic, the IOM committee
argues. In some studies, 60
-80% of HIV infected blood donations
were also positive for hepatitis B. Clearly, this would have
made a dramatic difference in HIV transmission had it been in
place
? The government failed to communicate to physicians and patients
treating those at risk for HIV through blood products the extent
of the problem -- thus denying them the chance to consider
alternative therapies that might have reduced their risk of
contracting HIV.
Recommendations
Among the recommendations of the committee are: appointment of a

-level Blood Safety Director who can coordinate protection of
the blood supply; the establishment of a Blood Safety Council,
with more independent representation, to advise the government on
blood policy issues; and "the Federal government should consider
establishing a no
-fault compensation system for individuals who
suffer adverse consequences from the use of blood or blood
products."
The recommendation regarding compensation is made prospectively,
but the committee says the "no
-fault' principles
outlined might serve to guide policymakers as they consider
whether to implement a compensation system for those infected in
the 1980s."
The Administration's Response
Secretary Shalala will be taking the lead in responding, since
this is an issue within HHS and she requested the IOM report.
No specific response will be made immediately to the
recommendations, other than to note that many of the
recommendations and needed improvements in protecting the blood
supply have already been made.
The Secretary will announce appointment of a task force (chaired
by Assistant Secretary for Health Phil Lee) to assess the
recommendations that are not already in place, including the
issue of compensation for those who were infected during the
1980s.
Other issues
You should know that Kathleen Gerus, just appointed to the
President's HIV/AIDS Advisory Council, is a member of the board
of the National Hemophilia Foundation. She is part of a new
leadership team installed in response to the problems the report
addresses. Also, Frank Young, who was Commissioner of the FDA
during much of the period under review, is still working for the
Public Health Service, in charge of emergency preparedness. In
addition, you should know that Jeff Levi worked on this issue as
Washington representative of the National Gay Task Force at the
time.

DENVER (AP) Gov. Roy Romer vetoed a bill banning same-sex
marriages Monday, saying such unions may deserve legal recognition.
``It is one thing to believe, as I do, that marriage is the
union of a man and a woman," Romer, a Democrat, said. ``It is
quite another to believe that committed same-sex relationships do
not exist and should not be recognized by society.
``We cannot prohibit or ban these relationships, and we
shouldn't use our law to attempt to do so," he said.
The bill won final approval in the Colorado Legislature earlier
this month. The bill passed 33-31 in the House and 20-14 in the
Senate, so it is unlikely supporters could get the two-thirds
majority needed to override the governor's veto.
The bill is similar to legislation in other states introduced in
response to a court case in Hawaii that could result in a ruling
legalizing gay marriages as early as this year.
Since states customarily recognize each other's statutes, such a
ruling in Hawaii could force the other 49 states to grant
homosexuals in same-sex unions the same financial, legal and social
benefits afforded to married heterosexuals.
Supporters of the Colorado bill accused Romer of bowing to
political pressure. But Romer, a three-term governor who is barred
by law from serving another term, called the legislation
mean-spirited and unnecessary.
``Let's be honest. Some support this bill because it is a way to
single out and condemn the lifestyle of gay and lesbian people,"
he said.
Leslie Reed and Sharon Espinosa, a lesbian couple expecting
their first child, said the governor's action was a step in the
right direction. "We're in the long run going to be recognized as
a family," Espinosa said.
Will Perkins, chairman of Colorado For Family Values, condemned
the veto.
``The governor is absolutely unaccountable to the electorate,"
he said. ``He is in the pocket of pro-homosexual interests and is
attempting to hold the state hostage."
Colorado was boycotted and labeled the "hate state" after
approving an anti-gay-rights measure in 1992 that banned local laws
protecting gays from bias in employment, housing and public
accommodations.
The ballot measure, written by Perkins' group, was struck down
by state courts and never took effect. The U.S. Supreme Court is
expected to rule on the challenge this year.
Perkins said his group will consider bringing forward a ballot
initiative banning same-sex marriages in Colorado.

MEMORANDUM For All Blue Photo Passholders

SUBJECT: Helicopter Departure of the President
On Wednesday, March 27, at 8:40 a.m. all those with blue photo
passes are cordially invited to the South Lawn for the
President?s departure via Marine One.

The lawn opens at 8:40 a.m. and closes promptly at 9:10 a.m.
The President is scheduled to arrive at 9:25 a.m. and depart
at 9:40 a.m.

You may escort up to two guests. You must clear each guest
through WAVES. Since volunteer and intern blue passholders
cannot make appointments, they cannot escort guests someone
else has cleared.
-
Passholders are required to stay with their guests until the
President has departed. You may not "drop them off" on the
South Lawn. Passholders and guests must remain in the
designated roped
-off viewing area.
-
Please do not bring food or beverages with you. You may not
ask the President for an autograph, nor attempt to hand him
anything.
If your office is in the West Wing or OEOB, please use the
service route under the north portico to the booksellers area.
Visitors Office staff will control access and direct you through
the Kennedy Garden to the east side of the driveway. East Wing
passholders should also use the outside route to the booksellers
area. Tours will be in progress, so please follow directions
carefully.
Regardless of the location of your office, all staff and guests
must exit through the Jacqueline Kennedy Garden and continue
through the booksellers area to the north service drive. No one
may enter the residence. West Wing passholders continue to West
Executive Avenue, while East Wing passholders may return through
the East Portico.
No Residence or West Wing tours may be given during working
hours.

I spoke with Steve, who had nothing but nice things to say -- in
appreciation for holding on to the $119 for Ryan White in the
smaller add back package, and for your having laid out the case
for the consolidated appropriation yesterday.
He continues to believe that the transfer authority is not an
acceptable compromise. I expressed concern that if we held to the
Pelosi language but did not get it, we would be blamed for not
having fought hard enough. Steve said that we need to put it on
the table, it is "our job to fight for it."
A seemingly sane conversation on this subject. A novelty.

In an effort to better the communication flow, I am asking Pat to
start distributing via email as of this afternoon and on Fridays
in the future a four week calendar showing highlights on my
schedule with date, time, and staffing assignment as appropriate.
We will in general not include the regularly scheduled meetings
nor internal meetings.
HOWEVER, I want to warn everyone:
1. This is an INTERNAL document to the DPC and not to be shared
with anyone else verbally or on paper.
2. This is not the complete schedule and does not include many
pending appts. and trips.
3. This must NOT be used when you are asked if you know if I am
available on a certain date....I am asking that you ALWAYS refer
such calls to Pat or better yet, ask the calling party to submit a
letter to Pat. I don't want to go overboard on stressing this
point but I must ask that you NOT use this calendar to say to
people it looks like I can or cannot do a requested
event/meeting/speech. Once a scheduling request is received Pat
presents it to me to make a determination as to how we handle it;
sometimes this means we adjust the current schedule (this is the
reason it is dangerous to tell someone I am already booked; they
might then decide not to send an invitation that might be a very
important one to the administration; we are known to make periodic
adjustments to my schedule), sometimes we outright accept, other
times we decline.
Again, you will get a four week listing today with an updated
version each Friday. Any questions about the schedule should be
referred to Pat.

Seattle AND Sf would be a good combination, if you can swing that,
since they are different sizes, different histories, and somewhat
different approaches. If I had to choose one, however, I'd do SF
-- the AIDS office there has done some very impressive things
around evaluating and changing the structure of how things are
done with Title I. There are also some good people at UCSF you
could talk with about their work around the country on Ryan White.
Another hook -- we are doing these town meetings around the
country, including San Francisco in late May (combined with some
site visits) -- so that might be something to join up with.
Let me think about this some more and we can talk tomorrow when
I'm back in the office.

Scott--I have taken a look at the compilation of National
Commission recommendations. I think it would be an unreasonable
task for all concerned -- the Council and the Administration folks
-- to try to review and assess every recommendation. Some are
very dated (for example, the first report was written to directly
influence passage of the Ryan White CARE Act; we certainly don't
have to revisit that!), some, as you observed, are not relevant to
the executive branch, and some just aren't that important any
more. I think it might make sense to focus on the "original" 30
(in whatever order you pick) and then highlight some from
"specialty" report -- e.g., housing, substance abuse. Since so
many overlap with the Council's recommendations, spending too much
time on the Commission's recommendations will diminish the
centrality of the council's recommendations to this assessment.
As far as answering the claims that we don't need a Council, we
just need to address the old commission's recommendations: I don't
think the most comprehensive analysis of the commission will ever
silence those critics -- they just want to say the Council isn't
needed. I bet most of those folks couldn't tell you what was in
the Commission reports. So, while we should acknowledge the
importance of the Commission, we also should be unembarrassed
about moving forward. Too much time on the Commission may seem
defensive about what the Council is doing -- and that's not
necessary at all; the Council's work can stand on its own right.
Let me know what you think. I was not in the office today
(Wednesday), but will be the rest of the week and we can go
through the old recommendations to pick some out.

A new survey of more than 1,500 adults found that Americans think
schools should teach preteens about AIDS and that television stations should
advertise condoms. The survey, released by the Kaiser Family Foundation,
revealed that Americans are more knowledgeable about AIDS and HIV than other
issues, although they still have misconceptions. For example, more than
half of the respondents believe that donating blood is risky. Twelve
percent believe that AIDS is God's punishment for homosexual behavior, and
18 percent believe there is "some truth" to reports that HIV was produced in
a germ-warfare laboratory.
"New Magic Act Means Handling Diverse Tasks"
USA Today (03/27/96) P. IC; Johnson, Earvin
Magic Johnson, who has HIV and recently returned to professional
basketball, reports in USA Today that he is no longer afraid of the virus,
that his immune system is strong, and that being a husband and father has
improved his life. He says his life is more varied now, with his roles as
family man, businessman, and AIDS activist. Furthermore, he claims that
setting an example for younger basketball players is especially important
now. Johnson notes that basketball and the players have changed since he
retired in 1991, and adds that he recognizes that he too has to adjust.
"HHS Awards Supplemental Grants for HIV/AIDS Services"
Reuters (03/26/96)
The Department of Health and Human Services awarded 41 cities nearly
$44 million in supplemental grants for care for low-income AIDS patients
last week. The money was granted under the Ryan White Comprehensive AIDS
Resources Emergency Act of 1990, but reflects only partial-year funding
because Congress is still working on the department's 1996 budget. Since
1991, more than $1 billion has been given to cities through the Ryan White
CARE Act.
"U.S. Court Throws Out AIDS Privacy Award"

A California appeals court has rejected a $275,000 award won by a
former Delta Air Lines sales agent who alleged he was wrongly fired in 1991
because he revealed that he had HIV. The court panel found that Joseph
Sullivan's family could not collect the award because California law
prohibits compensation for pain and suffering if the victim dies before the
ruling is final, and
Sullivan died in 1995. Delta held that Sullivan was fired for
being unreliable and frequently absent from work. A jury made
the award based on the decision that the company had invaded
Sullivan's privacy by posting his name on a report on
HIV-positive employees.
"Pneumococcal Conjugate Vaccine Safe, Immunogenic in HIV-Infected
Children"

A 5-valent pneumococcal conjugate vaccine is as safe as, and maybe more
effective than, a licensed 28-valent polysaccharide
vaccine for the prevention of invasive pneumococcal infection in
children with HIV. Dr. James C. King, Jr. and colleagues at the
University of Maryland compared the two vaccines in 30
HIV-infected children and 30 noninfected children. Children in
both groups showed greater increases in titers with the
pneumococcal conjugate vaccine. King says further studies are
needed to test repeated doses of the vaccine in immunocompromised
children.
"Cell Genesys Gene Therapy Promising in Early Trial"

An experimental HIV therapy, in which T-cells are taken from an
HIV-negative donor, genetically altered to target HIV, and
infused into an HIV patient, has shown promise in an early trial,
announced Robert Walker of the National Institutes of Health at a
recent meeting. Volunteers are currently being recruited for a
Phase II trial, to be sponsored by Cell Genesys Inc. and Hoechst
Marion Roussel and conducted by researchers at the National
Institute of Allergy and Infectious Diseases. The therapy,
which could be used in combination with antiviral drugs, may help
restore immune function in AIDS patients.
"Paromomycin Effective Against Cryptosporidiosis in AIDS
Patients"
Reuters (03/26/96)
Paromomycin, an aminoglycoside antibiotic, seems to give AIDS patients
with cryptosporidiosis relief from diarrhea and
stabilize weight loss. A study of 32 patients who completed four
weeks of therapy with the drug found that nearly half experienced
a decrease in diarrhea and weight gain or at least weight
stabilization. Only 9 percent were cured, however. Dr. Timothy
P. Flanigan of the Miriam Hospital in Providence, R.I., and
colleagues concluded that paromomycin should be considered
initial therapy for cryptosporidiosis in AIDS patients until a
more effective therapy is available.
"Lytic Growth of Kaposi's Sarcoma-Associated Herpesvirus (Human
Herpesvirus 8) in Culture"
Nature Medicine (03/96) Vol. 2, No. 3, P. 342; Renne, Rolf;
Zhong, Weidong; Herndier, Brian; et al.
HIV is known to be a major risk factor for Kaposi's sarcoma (KS), but
the cancer can occur in the absence of the virus. Homosexual men with AIDS
are 20 times more likely to develop KS than women and children with the
disease, a fact which suggests that a sexually transmitted agent may be
involved in the development of KS. A newly identified herpesvirus,
KS-associated herpesvirus (KSHV), or human herpesvirus 8 (HHV8), is this
suspected agent. The lack of a cell culture system for the virus' growth
has hindered research into its role in KS, but Don Ganem of the University
of California at San Francisco and colleagues report that they have
developed a system for growing the virus. This system will enable detailed
study of viral replication, the testing of antiviral drugs, and the
development of tests to screen for viral infection.
"Curcumin: Clinical Trial Finds No Antiviral Effect"
AIDS Treatment News (03/01/96) No. 242, P. 1; James, John S.
Curcumin, an ingredient in the curry spice turmeric, was tested in a
clinical trial with 40 volunteers and found to have no effect in reducing
viral load or increasing CD4 cell counts. The study was conducted by the
Community Research Initiative (CRI) of New England, a community-based
research organization. Although curcumin has shown anti-HIV activity in
cell cultures in laboratory tests, an earlier clinical trial was
inconclusive.
Jim Hellinger of CRI said that "despite the lack of apparent
antiviral or CD4 effects, most participants liked taking
curcumin, and felt better about taking it." A blood test for
curcumin levels may provide more information about why no
antiviral activity was documented.
"South Africa's AIDS Play Provokes Controversy"
Lancet (03/02/96) Vol. 347, No. 9001, P. 610; Lee, Nick
A debate has arisen in South Africa over the Department of
Health's funding of a musical about AIDS awareness, called
"Sarafina 2." The department has provided $3.45 million for the
show, which was written by Mbongeni Ngema. The money was donated
by the European Union (EU), which said it had allocated $12
million to AIDS awareness efforts in South Africa, but had not
designated money for the play itself, as the Department had
claimed. Department officials are now prohibited from talking
about the situation with the media, although Manto Tshabalala's
parliamentary portfolio committee on health will be investigating
the controversy.

President Clinton Challenges America to
Ensure our Children's Educational Future
March 27, 1996
Speech to the National Governors' Association Education Summit.
Today, President Clinton speaks to the National Governors'
Association, in Palisades, New Jersey, about our challenge to
improve education for America's children. The President will urge
states, communities, businesses, parents, teachers and students
to come together to meet this national challenge.
A critical challenge that demands action. We must face two basic
realities: Some of our public schools are failing and we cannot
walk away. If we work together, we can revitalize our schools.
President Clinton is doing everything in his power to focus
America's attention on this urgent challenge.
Real progress. President Clinton has helped America make real
progress on meeting this challenge by giving communities more
flexibility and demanding more accountability in return. He has:

Enacted Goals 2000, emphasizing standards and
accountability;
*
Worked with businesses and communities to make the
School
-to
-Work program a reality;
*
Cut regulations at the Department of Education by half, and
revised the rest to encourage flexibility and emphasize
results.
*
Helped take guns and drugs out of our schools with the Gun
Free Schools Act, the Safe and Drug Free Schools initiative
and by supporting random drug testing of student athletes.
Five challenges. In today's speech, the President will issue six
new challenges to states, communities, businesses, parents,
teachers and students to make our schools stronger.
1. Standards for students:
A. "No free pass." Challenge every state to develop
achievement tests at every level that students must
pass to graduate or be promoted. If students aren't
ready to move on, we must work with them after school
and over the summer, and if necessary, hold them back.
B. Every Child Reading by the End of Third Grade. Set a
concrete standard for the most basic of skills:
reading. Every school district, teacher and parent,
must be committed to a ensuring that every child is
reading by the end of the third grade, and every parent
should read to their child 30 minutes a day.
2. Standards for teachers:
A. Change Certification Rules that Bar Many Talented Young
People from being Teachers: Support alternative
certification procedures with high standards to bring
talented people into teaching as long as high standards
are met. Governor Clinton reformed certification
procedures in Arkansas. We should do it everywhere.
B. Reward Excellent Teachers and Find Ways to Dismiss
Incompetent Teachers: Challenge teachers to meet high
standards for performance and states to reward them
when they do. Make it easier and cheaper to remove
incompetent or ineffective teachers, while providing
more rewards for successful teachers and schools. We
shouldn't bash teachers; we should try to find ways to
keep the best teachers in the classroom.
3. Standards for our schools:
A. Focus on teaching, not administration. Challenge
states to cut regulation and overhead, and spend more
on the classroom, not on administration.
B. Public school choice, charter schools. President
Clinton believes that parents should be given the right
to choose which public school their children will
attend. The President's balanced budget calls for seed
money to help start 3,000 charter schools over the next
five years.
C. Close or fix broken schools. Challenge states to take
direct action to shut down or fix schools that don't
work.
4. Make schools safe, disciplined and drug free.
A. Permit Uniforms and Drug Testing. Support School
uniforms and other innovative approaches to increase
discipline and reduce violence. In Long Beach, school
uniforms have helped reduce school crime 36%.
B. Make It Easier for Teachers and Schools to Take
Appropriate Disciplinary Action. Children can't learn
and teachers can't teach unless there is order in the
classroom. More states should follow the lead of
Indiana, New York and Maryland in giving teachers and
schools the power to remove disruptive students.
C. Enforce tough truancy laws. Follow the model of
Police Chief Reubin Greenberg in Charleston, South
Carolina.
D. Community Schools as Safe Havens. Support Crime Trust
funding that encourages community schools to stay open
for longer hours -- at the time when students need a
safe haven and when most juvenile crime is committed.
We must provide young people a safe place to go to keep
off the streets, particularly during the peak hours of
juvenile crime -- between 3:00
-6:00 p.m.
5.
Accept technology literacy challenge for all students.
A. Ensure that Technology Literacy Challenge is Met for
Every Schools and Every Student: States and local
communities must ensure that students do not become
divided by access to technology. States should accept
the President's $2 billion Technology Literacy
Challenge to help ensure that all students are
technologically literate and all schools can meet the
four pillars of the technology literacy challenge:
classrooms wired to the information superhighway;
computers in every school and classroom;
technology
-trained teachers, and engaging learning
software that challenges students.
B. Ensure Teachers Can Teach Their Students to Become
Technologically Literate: Work with teacher unions,
colleges and corporate America to ensure that every new
teacher can use and teach technology.

I have been remiss in getting to both of you some ideas for
people to speak with the Services Committee on the subjects you
outlined for the subcommittee briefing.
We have reserved a meeting room at the same hotel as the Advisory
Council meeting for Wednesday so that there will be
continuity, etc. SSS will be providing the support.
Mary, I am sure you have some people in mind for this as well. I
have tried to identify mostly government people but have a few
ideas for outside folks as well. It would be nice to have more
than the usual advocacy groups that are based in Washington, but
in fact the Council has not formally heard from them and we will
not be able to pay for outside folks to come to town.
So here's my first cut:
1. Background on the HIV epidemic with a focus on service
implications.
John Ward from CDC is their designee for the basic epidemiology
and trends.
I would suggest then passing the baton over to HRSA with Ciro
Sumaya (accompanied by Joe O'Neill) giving some perspectives on
the impact of this epidemiology on the demand for services and
the programs HRSA runs.
2. Defining Services
I think Joe O'Neill (accompanied by an outside clinician as well)
could do a good job of defining the continuum of care and
services that people living with HIV need. (Joe suggested
Barbara Arranja -- and offered that HRSA could pay her travel
since she is a member of the HAAC.)
Barbara Garcia, the AIDS coordinator at SAMHSA could do mental
health and substance abuse services. I would look to her to
identify a mental health advocate; Ellen Weber from the Legal
Action Center would be great for substance abuse.
On social services needs, Buck Buckingham from HRSA plus someone
representing a CBO.
3. Access to services
A. Ryan White CARE Act -- Anita Eichler and Deborah Parham (and
who from Title IV?) -- could give an overview of the CARE Act
programs with representatives from outside groups talking about
their needs. (See below.)
B. Organization of care, including managed care initiatives:
Rachel Block from HCFA, Marilyn Gaston from HRSA, Ruth
Finkelstein from New York, Marla Gold from Philadelphia.
C. Financing (Medicaid, Medicare): Rachel Block of HCFA for an
overview (Note: it might make sense to switch B and C, since so
much of the managed care discussion requires an understanding of
Medicaid.)
[Given all we have gone through with the AETCs how about:
D. Professional education: Enrique Fernandez from HRSA, and some
folks in the field doing this work.]
Query: I think the day could be more efficiently done if we don't
try to have respondents to each of these government programs --
but rather invite a panel of four or five people from outside to
respond to the overall government response in providing access to
services. Since they all need to fit together as one, this would
make sense. The groups I would choose from are: AIDS Action,
NAPWA, CARE Coalition, AIDS Policy Center, Pediatric AIDS
Foundation, National Alliance of State AIDS Directors. We should
add some real people.
4. Housing issues I would look to Fred Karnas, the AIDS
coordinator at HUD and the coalition of housing advocates run out
of AIDS Action.
So, this might break out into the following panels:
1. Overview: epidemiology and general implications for services
2. Defining Services
3. AIDS specific government programs providing services: Ryan
White
4. Broader government programs supporting care: Medicaid plus
managed care issues
5. Professional education
6. Response from the community
7. Housing
This would be a full day. We may want to consolidate some of
this.
In any case, this is my first cut Mary, give me a call so we
can talk this through some more.

I looked at the general counsel's opinion -- and find it rather
weak. It seems to be based on the fact that Title II is more
restrictive about housing, while Title I has no definition of
housing services -- and jumps to the conclusion that this narrower
definition should apply to Title I. Title I has always had a
broader mandate.
In any case, here's the plan. I spoke with Nan Hunter at HHS
general counsel -- she will look into the matter as soon as she
receives a copy of a formal comment on the proposed guidance --
which AIDS Action will be doing shortly. That will give an
opportunity for higher level review and a possible
reinterpretation.

RReform Rabbis Approve Civil Gay Marriages
PHILADELPHIA (AP) A group of Reform rabbis endorsed the
legalization of homosexual marriages Thursday but stopped short of
recommending that rabbis perform the ceremonies.
The 1,750-member Central Conference of American Rabbis is the
first major group of Jewish leaders to formally oppose government
bans on same-sex marriages.
"As Jews, and specifically in the Reform movement, we've always
expressed concern for those we feel aren't treated fairly," said
Rabbi Robert Klensin of Arnold, Md., before an overwhelming voice
vote.
Most of the comments during the vigorous debate centered on an
amendment specifying that the group was not deciding the
controversial issue of rabbis officiating over single-sex
ceremonies.
"You cannot call upon the state to allow these marriages and
then refuse to perform the marriage," said Rabbi Eric B. Wisnia of
Princeton Junction, N.J.
But Rabbi Simeon J. Maslin, the conference president, said the
resolution ``is a matter of civil rights. It is certainly not
connected to any question of rabbinic officiation."
Maslin said the organization expects to vote on single-sex
marriage officiation at next year's meeting in Denver.
CCAR voted six years ago to accept gay and lesbian rabbis into
its ranks.

new report. The 1994 total was 938. AIDS was the leading cause

The chances of a health-insurance reform bill, aiming to
restrict insurance companies' ability to refuse coverage to
people with pre-existing conditions and guarantee continued
coverage to those who lose or change jobs, may be complicated by
amendments from Senate Republicans. The bill's sponsors, Sens.
Nancy Kassebaum (R-Kan.) and Edward Kennedy (D-Mass.), urged
lawmakers not to amend the legislation. Amendments may be
proposed to raise the health-insurance tax deduction for the
self-employed and to add provisions for medical savings accounts
and medical-malpractice awards.
"Zimbabwe's AIDS Orphans to Reach 600,000 by 2000"

Zimbabwe will have more than 600,000 orphans due to AIDS by
the year 2000, Margaret Mehlomakulu, deputy director of the
National AIDS Coordinating Program, said at a workshop Wednesday.
She said that AIDS would be a heavy burden on the government and
the community as they would be forced to stretch available
resources to take care of the orphans. Mehlomakulu called for
health officials to work with the community to help prevent young
people from becoming HIV-infected. An estimated I million
Zimbabweans, of a total 10.5 million, have the virus.
"Death Rates High Among New York Welfare Recipients--Study"

Rates of AIDS, tuberculosis (TB), and death are much higher
among New York City welfare recipients and applicants who have
been abusing alcohol, drugs, or both, an eight-year survey has
found. The research, led by Lloyd Friedman of the Yale
University School of Medicine, found that between 1984 and 1992,
5.5 percent of the 858 people studied developed TB, 10 percent
had AIDS, and 21 percent died. All 858 had a history of abusing
drugs, alcohol, or both. The TB rate for these individuals, the
majority of whom are single black men, is nearly 15 times the
usual rate in New York City, while the AIDS rate is 10 times the
average, and the death rate is five times the usual.
Ninety-three percent of the participants agreed to undergo a
two-part medical exam, which the researchers hoped would result
in treatment for people at high risk for AIDS or TB.
"Influenza Immunization in HIV-Positive Children Does Not Enhance
HIV Replication"

Although some researchers have suggested that influenza
vaccination may activate T-cells and enhance HIV replication, new
research has revealed only short-term increases in viral load in
children following immunization. Octavio Ramillo and colleagues
at the University of Texas Southwestern Medical Center in Dallas
saw the increased HIV RNA in five of 16 children, and said the
viral load returned to baseline in four of those five children
within eight weeks. The findings add to the evidence that the
viral burden increases after immunization more often in
HIV-positive adults than in children.
"Zimbabwe's Maternal Mortality Deaths Rising"

The incidence of maternal mortality has increased in
Zimbabwe as the number of HIV-infected pregnant women has risen,
a local gynecologist reported Wednesday. Kudakwashe Kangwende
said the infant mortality rate has been made worse by pre-natal
mortality associated with HIV infection and AIDS among pregnant
women. Kangwende said that frequent and unwarranted pregnancies
among women with AIDS contribute to the increasing maternal
mortality rate, and suggested that women with AIDS should be
allowed to have abortions. He also said the AIDS pandemic was
causing the spread of other diseases uncommon in Zimbabwe,
including genital herpes and cervical cancer.
"Physicians' Experience with the Acquired Immunodeficiency
Syndrome as a Factor in Patients' Survival"
New England Journal of Medicine (03/14/96) Vol. 334, No. 11, P.

et al.
Mari Kitahata and colleagues examined the link between
physicians' experience with AIDS and the survival of their AIDS
patients. They studied the cases of 403 men enrolled in a health
maintenance organization who were diagnosed with AIDS between
1984 and mid-1994. The patients' 125 primary care physicians
were separated into three levels of AIDS experience, based on
experience with AIDS during residency training and the cumulative
number of patients with AIDS they had treated in practice. The
authors concluded that patients cared for by doctors with the
most experience had a 31 percent lower risk of death than
patients cared for by physicians with the least experience.
Among the 224 patients diagnosed with AIDS between 1989 and 1994,
the risk of death was 43 percent lower for patients of the most
experienced doctors than for patients of the least experienced.
The study suggests that physicians who treat AIDS patients go
through a similar learning period and begin to improve their
management skills early in their experience. The authors found
that certain methods of treatment and a tendency to follow
HIV-infected patients more closely were associated with higher
levels of physicians' experience and longer patient survival.
"Rogue Science or Reality?"
Insight (03/11/96) Vol. 12, No. 10, P. 16; Goode, Stephen
Peter Duesberg, biology professor at the University of
California at Berkeley, member of the National Academy of
Sciences, and federal grant recipient, is criticized by many
scientists because he opposes the accepted belief that HIV causes
AIDS. Duesberg's book "Inventing the AIDS Virus" outlines his
arguments and challenges his colleagues to answer them. He says
the HIV-AIDS theory was announced hastily by federal health
officials in 1984 because groups like the National Institutes of
Health were under intense pressure to come up with an answer to
the growing AIDS epidemic. No one questioned the connection
later, he says, because billions in federal funding was being
spent on confirming it. Furthermore, Duesberg criticizes AIDS
researchers for abandoning long-held principles about viruses.
In other viral infections, antibodies are a sign of the body's
defense, but with HIV, antibodies are looked at as a sign that
the virus is still potent. AIDS researcher Robert Gallo has said
that because AIDS was completely new, redefining the rules was
necessary. Other researchers argue that HIV's ability to mutate
rapidly makes it a special case. Duesberg says that lifestyle
factors--including drug use, repeated cases of sexually
transmitted diseases, and malnutrition--are to blame for AIDS.
Duesberg is not alone in his beliefs--the 100-member Group for
the Scientific Reappraisal of the HIV-AIDS Hypothesis supports
him.
"Principals in HIV Blood Scandal Should be Summoned by Diet"

In an editorial in the Nikkei Weekly, the authors note the
Diet's lack of involvement in Japan's tainted blood scandal,
which caused some 1,800 Japanese hemophiliacs to be infected with
HIV. An investigation by the Ministry of Health and Welfare
revealed that contaminated blood products were distributed even
though members of government and industry knew of the HIV threat.
However, the investigation's interim report fails to answer
whether or not the ministry proposed emergency imports of safe,
heat-treated blood products. The editors question the actions of
Takeshi Abe, who headed the AIDS task force, as well as those of
his associate, Mutsumi Kazama, and the pharmaceutical companies
who continued to ship the untreated products even after the
threat of contamination was known. The editors claim that the
ministry investigation is not likely to provide satisfactory
answers and that the participants should testify before the Diet.

A new survey of more than 1,500 adults found that Americans think
schools should teach preteens about AIDS and that television stations should
advertise condoms. The survey, released by the Kaiser Family Foundation,
revealed that Americans are more knowledgeable about AIDS and HIV than other
issues, although they still have misconceptions. For example, more than
half of the respondents believe that donating blood is risky. Twelve
percent believe that AIDS is God's punishment for homosexual behavior, and
18 percent believe there is "some truth" to reports that HIV was produced in
a germ-warfare laboratory.
"New Magic Act Means Handling Diverse Tasks"

Magic Johnson, who has HIV and recently returned to professional
basketball, reports in USA Today that he is no longer afraid of the virus,
that his immune system is strong, and that being a husband and father has
improved his life. He says his life is more varied now, with his roles as
family man, businessman, and AIDS activist. Furthermore, he claims that
setting an example for younger basketball players is especially important
now. Johnson notes that basketball and the players have changed since he
retired in 1991, and adds that he recognizes that he too has to adjust.
"HHS Awards Supplemental Grants for HIV/AIDS Services"

The Department of Health and Human Services awarded 41 cities nearly
$44 million in supplemental grants for care for low-income AIDS patients
last week. The money was granted under the Ryan White Comprehensive AIDS
Resources Emergency Act of 1990, but reflects only partial-year funding
because Congress is still working on the department's 1996 budget. Since
1991, more than $1 billion has been given to cities through the Ryan White
CARE Act.
"U.S. Court Throws Out AIDS Privacy Award"

A California appeals court has rejected a $275,000 award won by a
former Delta Air Lines sales agent who alleged he was wrongly fired in 1991
because he revealed that he had HIV. The court panel found that Joseph
Sullivan's family could not collect the award because California law
prohibits compensation for pain and suffering if the victim dies before the
ruling is final, and
Sullivan died in 1995. Delta held that Sullivan was fired for
being unreliable and frequently absent from work. A jury made
the award based on the decision that the company had invaded
Sullivan's privacy by posting his name on a report on
HIV-positive employees.
"Pneumococcal Conjugate Vaccine Safe, Immunogenic in HIV-Infected
Children"

A 5-valent pneumococcal conjugate vaccine is as safe as, and maybe more
effective than, a licensed 28-valent polysaccharide
vaccine for the prevention of invasive pneumococcal infection in
children with HIV. Dr. James C. King, Jr. and colleagues at the
University of Maryland compared the two vaccines in 30
HIV-infected children and 30 noninfected children. Children in
both groups showed greater increases in titers with the
pneumococcal conjugate vaccine. King says further studies are
needed to test repeated doses of the vaccine in immunocompromised
children.
"Cell Genesys Gene Therapy Promising in Early Trial"

An experimental HIV therapy, in which T-cells are taken from an
HIV-negative donor, genetically altered to target HIV, and
infused into an HIV patient, has shown promise in an early trial,
announced Robert Walker of the National Institutes of Health at a
recent meeting. Volunteers are currently being recruited for a
Phase II trial, to be sponsored by Cell Genesys Inc. and Hoechst
Marion Roussel and conducted by researchers at the National
Institute of Allergy and Infectious Diseases. The therapy,
which could be used in combination with antiviral drugs, may help
restore immune function in AIDS patients.
"Paromomycin Effective Against Cryptosporidiosis in AIDS
Patients"
Reuters (03/26/96)
Paromomycin, an aminoglycoside antibiotic, seems to give AIDS patients
with cryptosporidiosis relief from diarrhea and
stabilize weight loss. A study of 32 patients who completed four
weeks of therapy with the drug found that nearly half experienced
a decrease in diarrhea and weight gain or at least weight
stabilization. Only 9 percent were cured, however. Dr. Timothy
P. Flanigan of the Miriam Hospital in Providence, R.I., and
colleagues concluded that paromomycin should be considered
initial therapy for cryptosporidiosis in AIDS patients until a
more effective therapy is available.
"Lytic Growth of Kaposi's Sarcoma-Associated Herpesvirus (Human
Herpesvirus 8) in Culture"

Zhong, Weidong; Herndier, Brian; et al.
HIV is known to be a major risk factor for Kaposi's sarcoma (KS), but
the cancer can occur in the absence of the virus. Homosexual men with AIDS
are 20 times more likely to develop KS than women and children with the
disease, a fact which suggests that a sexually transmitted agent may be
involved in the development of KS. A newly identified herpesvirus,
KS-associated herpesvirus (KSHV), or human herpesvirus 8 (HHV8), is this
suspected agent. The lack of a cell culture system for the virus' growth
has hindered research into its role in KS, but Don Ganem of the University
of California at San Francisco and colleagues report that they have
developed a system for growing the virus. This system will enable detailed
study of viral replication, the testing of antiviral drugs, and the
development of tests to screen for viral infection.
"Curcumin: Clinical Trial Finds No Antiviral Effect"
AIDS Treatment News (03/01/96) No. 242, P. 1; James, John S.
Curcumin, an ingredient in the curry spice turmeric, was tested in a
clinical trial with 40 volunteers and found to have no effect in reducing
viral load or increasing CD4 cell counts. The study was conducted by the
Community Research Initiative (CRI) of New England, a community-based
research organization. Although curcumin has shown anti-HIV activity in
cell cultures in laboratory tests, an earlier clinical trial was
inconclusive.
Jim Hellinger of CRI said that "despite the lack of apparent
antiviral or CD4 effects, most participants liked taking
curcumin, and felt better about taking it." A blood test for
curcumin levels may provide more information about why no
antiviral activity was documented.
"South Africa's AIDS Play Provokes Controversy"
Lancet (03/02/96) Vol. 347, No. 9001, P. 610; Lee, Nick
A debate has arisen in South Africa over the Department of
Health's funding of a musical about AIDS awareness, called
"Sarafina 2." The department has provided $3.45 million for the
show, which was written by Mbongeni Ngema. The money was donated
by the European Union (EU), which said it had allocated $12
million to AIDS awareness efforts in South Africa, but had not
designated money for the play itself, as the Department had
claimed. Department officials are now prohibited from talking
about the situation with the media, although Manto Tshabalala's
parliamentary portfolio committee on health will be investigating
the controversy.

Even though I am not one of the addressees of your memo regarding
the discussion of OAR in conference yesterday, I feel compelled
personally to respond to you -- since I have been unable to reach
you by phone.
First, perhaps we have not been doing as a good a job as we could
at our end of communicating all that the Administration is doing
on behalf of OAR -- but it would have been nice if you had called
here before writing (and widely disseminating) memos that accuse
us of having been insufficiently supportive of the OAR in this
latest round of negotiations. In fact, the Pelosi language has
been supported in each round of negotiations, at various levels of
Administration interaction with the appropriations committee
leadership.
Second, if Mr. Porter said that Drs. Varmus and Paul were fully
satisfied with the resolution of the FY 1996 situation, we both
know this is inaccurate. Both Dr. Varmus and Dr. Paul made clear
that they strongly support -- and need -- the consolidated
appropriation. But I am sure they also made clear that the funds
being spent in the current fiscal year are being spent according
to the OAR plan -- something we all know to be true and support.
Thus, I do not think any of us can answer your question -- that is
written, frankly, more as an accusation than an inquiry -- as to
how the Administration's views can be so easily misrepresented.
Third, it sometimes seems to me that the only measure of adequate
support on this issue is success. We get no credit for our
advocacy and our support -- if Mr. Porter does not change his
position, then somehow we are to blame. I don't think I need to
remind you of the politics of this Congress for you to recognize
that this is not a fair standard.
Fourth, the Administration continues to support -- in this round
of negotiations, in the FY 1997 budget, in the reauthorization
process, and in our response to the Levine Report -- the full
authorities of the OAR.
Gregg, what has happened in this budget cycle is certainly an
indication of how hard a fight we have in front of us. I think
we have a much greater chance to succeed in preserving the OAR's
authority if we work together and don't have to spend lots of time
questioning the depth of this Administration's support. I think
the record shows that throughout the budget fight this year, the
President and everyone in the Administration has gone to the well
again and again for the OAR and for all AIDS programs.

Jeff,
I talked with Tim informally about this yesterday and the
non-conference. He thought that we would be in trouble if we were
ever called before a committee on the use of funds for housing. That
is, he seemed to agree with the current legal opinion. He did not
think it likely that any attention would ever be focused on this issue
and that we would be best to draw as little attention to it as
possible. You may want to talk with him directly before proceeding.

I looked at the general counsel's opinion -- and find it rather
weak. It seems to be based on the fact that Title II is more
restrictive about housing, while Title I has no definition of
housing services -- and jumps to the conclusion that this narrower
definition should apply to Title I. Title I has always had a
broader mandate.
In any case, here's the plan. I spoke with Nan Hunter at HHS
general counsel -- she will look into the matter as soon as she
receives a copy of a formal comment on the proposed guidance --
which AIDS Action will be doing shortly. That will give an
opportunity for higher level review and a possible
reinterpretation.
