A rather disturbing incident for SSS has been created by Bruce Weniger. It
seems that he does not prefer to arrange or verify conference calls for the
Research Committee through SSS.
He sent me an email on Oct. 15 requesting the "host" access codes for the
Research conference calls in case Dr. Levine or someone from ONAP was not on
the call and the committee needed to access the AT&T operator. I sent the
code to both Bruce and Jane S. He the proceeded to telephone AT& T directly
(without contacting me) to "verify" the arrangements for the future
conference calls. Normally, AT&T will not adjust any of the calls with
notifying the "arranger/host" since this affects costs, billing, etc., but
since Bruce was able to provide them with the access code they made
adjustments that he requested. I was quite upset with AT&T for doing this
without contacting me first, since this can cause big problems for us and
the accounting of our contract funds. AT&T then further "investigated" to
find out which AT&T staff person had spoken with Bruce. It seems that Bruce
did not dial into AT&T using the SSS (800) account number and when
questioned by the AT&T operator as to why he didn't use our normal number,
he informed them that he "worked" with Kimberly Farrell at SSS, leading them
to believe he was a member of our staff and was authorized to make these
changes.
As you can understand, this could potentially lead to big trouble for
us...especially considering how SSS must carefully account for use of all
contract funds, the authorization of their use, billing, etc...we must
provide tons of back up documentation for any and all contract costs.. I
cannot adequately account for changes -- increases or decreases -- if I am
not aware of what is being arranged
You may want to contact Bruce to "explain" to him the standard procedures
everyone else on the PACHA is working under

NNIH Reconsiders Funding Needle Exchange Study
WASHINGTON (AP) The government agreed to reconsider Thursday
whether to pay for a $2.7 million study of needle exchanges in
Alaska after a consumer advocate charged the experiment was
"highly unethical."
The study would have recruited 600 intravenous drug users, but
only allowed 300 of them to get free clean needles in a newly
established needle-exchange program, said Dr. Sidney Wolfe of the
consumer group Public Citizen.
The other 300 would be blocked from trading their used needles
for clean ones, Wolfe wrote Thursday to director of the National
Institutes of Health, Harold Varmus. They would be told to try to
buy syringes from pharmacies. Then University of Alaska researchers
would test members of each group to determine which became more
infected with hepatitis B and the AIDS virus, diseases spread by
dirty needles, Wolfe said.
But previous studies have found needle exchanges cut new cases
of HIV infection by 33 percent in Connecticut and caused an
eightfold drop in hepatitis in Washington.
``It is simply unconscionable for the NIH, the nation's leading
health research institution, to fund a project that so clearly
violates basic research ethics in a manner that the researchers
themselves admit in their grant proposal `represents the
withholding of a potentially lifesaving service," Wolfe wrote.
By noon, Varmus had decided to review whether the study,
scheduled to start in Anchorage in December, should proceed.
"This study, when it was conceived and designed, was recognized
as ethically sensitive," said NIH spokeswoman Anne Thomas.
She noted that the study had been approved both by the
University of Alaska's review board and the federal Office of
Protection from Research Risks. But she could not immediately say
why the two groups deemed the study appropriate.
University of Alaska lead researcher Dr. Dennis Fisher did not
return a phone call.
The National Research Council and the Centers for Disease
Control and Prevention have declared needle exchanges effective,
but Congress in 1988 banned federally funded needle exchanges until
the surgeon general declared they work. The Clinton administration
has drawn the ire of AIDS activists for refusing to do that.
Critics charge the exchanges could encourage drug use.
The scientific findings make it unethical for Alaska researchers
to deny drug users the chance to use a needle exchange, Wolfe said.
Most such studies compare disease rates between addicts who
voluntarily use the nation's 55 privately funded needle exchanges
with addicts who do not, he said.
Also, the Alaska study did not offer the addicts a highly
effective vaccine against hepatitis B, he said.
About one-third of AIDS patients are infected through
intravenous drug use.

Biography:
Jeffrey Levi has served as Deputy Director of the White House Office of
National AIDS Policy since 1994. The Office of National AIDS Policy is is
part of the President's Domestic Policy Council and is responsible for
coordinating the federal government's response to the HIV epidemic. Mr.
Levi has been involved in AIDS policy issues since the beginning of the
epidemic. From 1990 to 1994 he was director of government affairs and
director of public policy and program development for the AIDS Action
Council and AIDS Action Foundation. AIDS Action is the only national
organization devoted solely to AIDS public policy advocacy. Mr. Levi has
worked on AIDS issues since 1983, when he joined the staff of the National
Gay and Lesbian Task Force as its Washington representative. He served
three years as its executive director.
Outline of a typical day:
I'm not sure I would describe any of the three days I was there as
"typical" from my viewpoint, but there were some standing agenda items that
facilitated the Office's work on a daily basis:
1. President's Domestic Policy Council conference call: 15-minute summary of
the President's activities for the day; information of concern or activity
needed from Office.
2. Office of National AIDS Policy check-in meeting: 10-minute summary for
Office staff of the day's meetings, conference calls, scheduling, and
events. Opportunity for each staff member to discuss high-priority
activities for the day.
3. Daily meeting with the Director: to bring Ms. Fleming up-to-date on
activity on any of a list of standing issues related to AIDS policy (e.g.,
immigration, welfare reform, SSI/SSDI, housing, Office administration
issues, strategy).
In addition, Mr. Levi's calendar was full of meetings that required his
attendance on behalf of the Office. These included: a meeting to discuss
involvement of the President and First Lady, and the Vice President and Mrs.
Gore in the display of the Names Project AIDS Memorial Quilt on the National
Mall; a meeting at the Office of Management and Budget with Department of
Health and Human Services agencies on FY1997 AIDS funding and activities;
and a meeting of the Treatment Access Subcommittee of the Presidential
Advisory Council on HIV/AIDS. The only activity from which I was excluded
(because of my status as a permanent career employee in the Executive
Branch) was Mr. Levi's participation in the Administration's response team
for the Vice Presidential Debate on October 9, 1996.
Finally, Mr. Levi kept a running list of telephone calls that needed to
be made. He was on the phone much of the time that he was not actively
engaged in another activity.
Notable characteristics:
Excellent oral communications skills: clear, direct, polite, sensitive
(e.g., specifically reminded caller to discuss particularly sensitive issues
with third party in advance of a public forum, so as to allow the third
party an opportunity to prepare for public forum).
Assertive problem solver: directly follows up to get responses or
results. Takes responsibility to resolve questions/issues rather than
waiting for others to offer the information. Explicitly asked in meetings
what the Office to could to move issues forward toward resolution.
Highly flexible: able to move easily from list of planned activities to
respond to an issue that needs immediate response, and then pick up again
with planned activities. Willing to assume whatever responsibilities are
necessary to complete the work of the Office.
High level of technical expertise: experienced dealing with full range
of issues related to HIV/AIDS policy: epidemiologic, biomedical, social,
health care financing, legal, political.
Recommendation for future programs:
I would highly recommend that the USDA Graduate School contact the
Office of National AIDS Policy in a formal manner to discuss future
collaboration to meet the needs of EPP participants and the Office. The
Office functions with only two White House FTEs (the Director and Deputy
Director positions). The rest of the staff consists of permanent employees
on voluntary, temporary assignments from other Agencies. The Office's
obviously strong leadership brings these people together into a cohesive
unit. EPP participants with knowledge of health care issues (AIDS in
particular, or general issues related to health care financing, access,
etc.), or with a desire to see how policy development occurs at the highest
level of the Executive Branch, would benefit from such an assignment."

The Clearinghouse's Educational Materials Databases contain
bibliographic information about more than 14,000 brochures,
videos, booklets, and other materials with education/prevention
messages.
NAC ONLINE users can search these databases by selecting
"Clearinghouse Databases" from the NAC ONLINE main menu. When
asked to enter a database name, specify "UNPB" (which stands for
unpublished materials) to search all materials, regardless of
availability; "CNPB" (which stands for current materials) to
search only materials currently available from the distributor;
or "ANPB" (which stands for archival materials) to search only
materials which are no longer available.
To access the NAC ONLINE BBS, set your communications software to
dial (800) 851-7245, and set the options for 8 data bits, N
parity, 1 stopbit, full duplex, and complete a new user
questionnaire. Only non-profit organizations, government
agencies, educational institutions, and health departments are
given full access to NAC ONLINE and the NAC databases.
Over the weekend, 10 newly catalogued materials were loaded to

NNIH Reconsiders Funding Needle Exchange Study
WASHINGTON (AP) The government agreed to reconsider Thursday
whether to pay for a $2.7 million study of needle exchanges in
Alaska after a consumer advocate charged the experiment was
``highly unethical."
The study would have recruited 600 intravenous drug users, but
only allowed 300 of them to get free clean needles in a newly
established needle-exchange program, said Dr. Sidney Wolfe of the
consumer group Public Citizen.
The other 300 would be blocked from trading their used needles
for clean ones, Wolfe wrote Thursday to director of the National
Institutes of Health, Harold Varmus. They would be told to try to
buy syringes from pharmacies. Then University of Alaska researchers
would test members of each group to determine which became more
infected with hepatitis B and the AIDS virus, diseases spread by
dirty needles, Wolfe said.
But previous studies have found needle exchanges cut new cases
of HIV infection by 33 percent in Connecticut and caused an
eightfold drop in hepatitis in Washington.
``It is simply unconscionable for the NIH, the nation's leading
health research institution, to fund a project that so clearly
violates basic research ethics in a manner that the researchers
themselves admit in their grant proposal represents the
withholding of a potentially lifesaving service," Wolfe wrote.
By noon, Varmus had decided to review whether the study,
scheduled to start in Anchorage in December, should proceed.
"This study, when it was conceived and designed, was recognized
as ethically sensitive," said NIH spokeswoman Anne Thomas.
She noted that the study had been approved both by the
University of Alaska's review board and the federal Office of
Protection from Research Risks. But she could not immediately say
why the two groups deemed the study appropriate.
University of Alaska lead researcher Dr. Dennis Fisher did not
return a phone call.
The National Research Council and the Centers for Disease
Control and Prevention have declared needle exchanges effective,
but Congress in 1988 banned federally funded needle exchanges until
the surgeon general declared they work. The Clinton administration
has drawn the ire of AIDS activists for refusing to do that.
Critics charge the exchanges could encourage drug use.
The scientific findings make it unethical for Alaska researchers
to deny drug users the chance to use a needle exchange, Wolfe said.
Most such studies compare disease rates between addicts who
voluntarily use the nation's 55 privately funded needle exchanges
with addicts who do not, he said.
Also, the Alaska study did not offer the addicts a highly
effective vaccine against hepatitis B, he said.
About one-third of AIDS patients are infected through
intravenous drug use.

It seems I've started a war with Bruce!!
Anyway in an attempt to explain -
All PACHA calls are always set up with the chair person being the "host" and
I send the host access codes to you guys as well
The problem with the last Research call being cut off was because the call
was only scheduled for one-hour. It wasn't made clear to me ahead of time
that they needed more time than that. For example, when Prevention provided
me with their "schedule" for calls they indicated they wanted 1 1/2 hours
which I arranged.
And...after the last Research problem I now went back and scheduled all
the Research calls for 2 hours. (I don't want to decrease this time in case
they run over.) Also, AT&T does not charge us for time that is not
used..so, it's better to schedule for more time than may actually be
needed
I think he is really overeacting I just don't want him arranging,
adjusting calls because I then can't track the charges until we receive the
AT&T bill..I have to provide Linda with estimates of costs on a weekly
basis

Ten Leading Nationally Notifiable Infectious Diseases -- United
States, 1995
The National Notifiable Diseases Surveillance System (NNDSS)
is a national passive surveillance system comprising 52
infectious diseases designated by the Council of State and
Territorial Epidemiologists as reportable to CDC (1). This report
is based on the Summary of Notifiable Diseases for 1995 (2) and
presents the most commonly reported nationally notifiable
diseases for 1995. During 1995, sexually transmitted diseases
(STDs) predominated and were reported among all age groups.
The 10 most frequently reported nationally notifiable
infectious diseases for 1995 were, in descending order,
chlamydia, gonorrhea, acquired immunodeficiency syndrome (AIDS),
salmonellosis, hepatitis A, shigellosis, tuberculosis (TB),
primary and secondary syphilis, Lyme disease, and hepatitis B
(2). The STDs of chlamydia, gonorrhea, AIDS, primary and
secondary syphilis, and hepatitis B accounted for 87% of cases
reported for these 10 diseases.
Although 1995 was the first year genital infections with
Chlamydia trachomatis were nationally notifiable, this condition
was the most commonly reported disease for 1995. Most cases were
reported among women; infection with C. trachomatis is tested for
and reported less frequently for men than for women. Rates for
AIDS and TB were substantially higher among males than females.
Consistent with previous surveillance data, the rate of AIDS
reported among men was more than four times that for women, and
for TB, nearly twice that for women. Except for AIDS, TB, and
genital infection with C. trachomatis, sex-specific rates of
notifiable diseases were similar.
The most commonly reported infectious diseases varied by age
group. Salmonellosis and shigellosis continued to be the most
common notifiable diseases reported among children aged less than
5 years (61.8 and 46.3 per 100,000 population, respectively).
Among children aged 5-14 years, gonorrhea and shigellosis (rates
of 21.8 and 20.1, respectively) were the most frequently reported
diseases. Gonorrhea remained the most common disease reported
among persons aged 15-24 years (645.0), and rates for both
gonorrhea and AIDS were high among persons aged 25-44 years
(162.4 and 65.3, respectively) and persons aged 45-64 years (22.3
and 27.8, respectively). Among persons aged greater than 65
years, TB was the most commonly reported notifiable disease
(16.3). Age-specific data about chlamydial infections were not
available for 1995.

Editorial Note: The findings in the Summary of Notifiable
Diseases reflect only diseases that are diagnosed by health-care
or laboratory workers and reported to state and local health
departments, who then report to CDC. Resources available for
conducting surveillance vary widely by disease (3). In addition,
patterns of detection and reporting probably vary by disease, age
or population group, state, and locality. Consequently, for many
of these conditions, the true incidences in the United States
probably are underestimated. Despite such limitations, however,
these and other surveillance data are useful for monitoring
trends and for determining relative disease burdens.
As part of the MMWR series, CDC will release on October 25
the Summary of Notifiable Diseases, United States, 1995 (2). This
publication contains summary tables of the official statistics
for the reported occurrence of nationally notifiable diseases
during 1995. Data for 1995 are presented by month; geographic
location; and patient age, sex, and race/ethnicity in maps and
graphs for many conditions. Also included are a brief history of
notifiable disease reporting, highlights of important
developments in the reported occurrences of selected
nonnotifiable diseases (e.g., dengue fever, hantavirus pulmonary
syndrome, penicillin-nonsusceptible Streptococcus pneumoniae, and
Ebola hemorrhagic fever), and data from the Public Health
Laboratory Information System.

Morbidity and Mortality Weekly Report (10/18/96) Vol. 45, No. 41,
Last year, sexually transmitted diseases (STDs) represented
87 percent of all cases of the 10 most frequently reported
infectious diseases in the United States, federal researchers
report. According to the Centers for Disease Control and
Prevention, the 10 most prevalent infectious diseases in the
United States in 1995 were, in descending order: chlamydia,
gonorrhea, HIV/AIDS, salmonellosis, hepatitis A, shigellosis,
tuberculosis (TB), syphillis, Lyme disease, and hepatitis B.
Rates for HIV/AIDS and TB were significantly higher among men
than women, with more than four times as many AIDS cases
reported in men than in women, and twice as many TB cases.
"Questions on Ethics Lead to Review of Needle-Exchange Study"

Amid charges that a proposed needle exchange study in Alaska
is unethical, the National Institutes of Health announced
Thursday that it would review the plan. The $2.7 million,
three-year study at the University of Alaska at Anchorage was
slated to begin recruiting patients in December. The researcher
will attempt to determine whether injection drug users can reduce
their risk of viral infection by exchanging their used needles
and syringes for clean ones. The Washington-based Public
Citizens' Health Research Group said the study was unethical
because it would deny access to clean needles to half of the drug
users, those in the control group. A spokeswoman for the NIH
said that the study had been approved by two ethics boards, but
that it would be reviewed again soon. Dennis G. Fisher, the
researcher leading the study, has defended it. He pointed out
that the control group would be told where to go for needles and
how to get them. He explained the study design is necessary to
prove that needle exchanges work.
"Biotech Firms Find Structure of Protein for Hepatitis C"

Vertex Pharmaceuticals and Agouron Pharmaceuticals have
separately identified the structure of a protein necessary to the
reproduction of the hepatitis C virus, sparking a more intense
competition between the two to find a drug for the treatment of
hepatitis C. The discovery, published in separate articles in
the Friday edition of the journal Cell, provides a starting point
to develop a drug that would interfere with the protease that
helps the virus to replicate. The research builds on the success
of HIV protease inhibitors, but the hepatitis C virus protease
may well be a more difficult target than the HIV protease,
because its working end is "broader and more open," notes Agouron
CEO Peter Johnson. Analyst Rachel Leheny of Hambrecht & Quist,
meanwhile, predicts that an effective drug for the treatment of
hepatitis C could bring in $2 million to $3 million in annual
revenue.

Merck is introducing its AIDS drug Crixivan in the European
market, hoping to prevent "parallel trading" of the drug between
countries by selling the drug at a fixed price across the
European Union (EU). The legal practice of parallel trading,
buying goods in the cheapest EU states and selling them for
higher prices in other places, is opposed by drug companies
because it harms the market and denies patients a steady supply
of medicine. While pharmaceutical makers have opposed such trade
for years, they now have on their side AIDS activists, who are
demanding access to powerful new drugs like Crixivan. However,
EU officials have not yet been persuaded that parallel-drug
trading is as detrimental as the industry claims.
"Ten-Year-Old Fraud Suit Settled for $14.5 Million"

ICN Pharmaceuticals reports that it has settled a
10-year-old class action investor lawsuit for $10 million in cash
and $4.5 million in common stock. According to an attorney for
the plaintiffs, the suit alleged that ICN had defrauded investors
by making claims about possible effects on patients of its AIDS
drug ribavirin. A New York jury rejected seven of 13 claims made
in the case, but was deadlocked over the remaining six and a new
trial date needs to be scheduled. A spokesman for the drug maker
notes that the company "has consistently maintained that the
allegations upon which it was based were false."
"Hospitals Keep Drug Packs in Case of AIDS Accidents"
Toronto Globe and Mail (10/17/96) P. A7; Coutts, Jane
Hospitals in Toronto are starting to prepare for the
accidental exposure of health-care workers to HIV by keeping
drugs to treat such exposures on hand. The plan is based on
recommendations made by the U.S. Centers for Disease Control and
Prevention in July, which call for treating HIV-exposed workers
with a combination of antiviral drugs that includes a protease
inhibitor. Studies in the United States have found that
immediate treatment can reduce a worker's risk of developing AIDS
by 70 percent. The CDC recommends that the drugs, which cost
about $1,200 per person, are used only in very high-risk cases,
like a deep prick from a needle that has been used on an AIDS
patient. The agency said the level of risk should be balanced
against the effects of the drug. The government of British
Colombia has stocked every emergency room in the province with
five-day starter packs of the drugs, to be available for anyone
accidentally exposed to HIV.
"PM's Brother Testifies at Blood Probe"

Concerns about the possibility of HIV being transmitted
through the blood supply had diminished by 1987, testified Michel
Chretien, co-chairman of a study about the disease with Justice
Horace Krever in 1987-1988, on Wednesday. Chretien, the brother
of Canadian Prime Minister Jean Chretien, was called by the
province of Ontario to testify at the federal inquiry into the
country's tainted blood scandal. Ontario is one of the parties
that could be cited for misconduct in Krever's final report for
failing to take precautions to protect the blood supply from HIV.
The Ontario government called Chretien to show that little was
known about AIDS, or how to protect the blood supply, at the
time.
"Inside Politics: Dating Clinton"

Members of the AIDS Coalition to Unleash Power, or ACT UP,
have placed an ad in the Washington Blade, Washington, D.C.'s gay
newspaper, urging AIDS activists not to support President
Clinton. "He keeps toying with our affections. Do we really
want another date with this man?" asks the ad.
"Physicians Try Unusual Drugs to Fight Cryptosporidium"

Creative new therapies are being developed to treat
cryptosporidiosis, the diarrhea-causing infection for which nearly
100 potential drugs have been tried. NTZ, a drug initially
developed for dogs with worms, will enter final testing at the
National Institutes of Health in November. AIDS patients are
demanding the drug, and are importing supplies from Mexico, where
it is used to treat both humans and animals. Moreover, of the
first 29 U.S. AIDS patients given NTZ, one-third experienced at
least some benefit. UniMed Pharmaceuticals is offering NTZ to 150
patients as an experimental therapy. Another drug is being
developed using the milk produced by cows just after giving birth.
The mothers' antibodies are thought to attach to Cryptosporidium
and help block its spread through the intestines.
Meanwhile, the biotechnology firm GalaGen is pretreating 250,000
cows to increase their antibody production. About half of the 21
AIDS patients treated in initial testing have reported
significant declines in diarrhea. The Centers for Disease
Control and Prevention's Dan Colley noted, "We need to be
cautious," though "we clearly need to think outside the normal"
drug therapies, which have failed.
"Tosoh Says it Has Created Way to Count Viral Particles in Blood"

Tosoh Corp., a Japanese chemical maker, has developed a new
method for measuring the number of viral particles in a blood
sample. The test, which uses a special ion-exchange resin to
isolate viral genes, may be used to diagnose viral infections and
has the potential to be automated. The company has reported that
the test can detect as few as 100 viral particles and is able to
give a count if at least 10,000 particles are present. The new
assay has been successfully tested on blood samples that
contained HIV and cytomegalovirus, Tosoh said.

Ten Leading Nationally Notifiable Infectious Diseases -- United
States, 1995
The National Notifiable Diseases Surveillance System (NNDSS)
is a national passive surveillance system comprising 52
infectious diseases designated by the Council of State and
Territorial Epidemiologists as reportable to CDC (1). This report
is based on the Summary of Notifiable Diseases for 1995 (2) and
presents the most commonly reported nationally notifiable
diseases for 1995. During 1995, sexually transmitted diseases
(STDs) predominated and were reported among all age groups.
The 10 most frequently reported nationally notifiable
infectious diseases for 1995 were, in descending order,
chlamydia, gonorrhea, acquired immunodeficiency syndrome (AIDS),
salmonellosis, hepatitis A, shigellosis, tuberculosis (TB),
primary and secondary syphilis, Lyme disease, and hepatitis B
(2). The STDs of chlamydia, gonorrhea, AIDS, primary and
secondary syphilis, and hepatitis B accounted for 87% of cases
reported for these 10 diseases.
Although 1995 was the first year genital infections with
Chlamydia trachomatis were nationally notifiable, this condition
was the most commonly reported disease for 1995. Most cases were
reported among women; infection with C. trachomatis is tested for
and reported less frequently for men than for women. Rates for
AIDS and TB were substantially higher among males than females.
Consistent with previous surveillance data, the rate of AIDS
reported among men was more than four times that for women, and
for TB, nearly twice that for women. Except for AIDS, TB, and
genital infection with C. trachomatis, sex-specific rates of
notifiable diseases were similar.
The most commonly reported infectious diseases varied by age
group. Salmonellosis and shigellosis continued to be the most
common notifiable diseases reported among children aged less than
5 years (61.8 and 46.3 per 100,000 population, respectively).
Among children aged 5-14 years, gonorrhea and shigellosis (rates
of 21.8 and 20.1, respectively) were the most frequently reported
diseases. Gonorrhea remained the most common disease reported
among persons aged 15-24 years (645.0), and rates for both
gonorrhea and AIDS were high among persons aged 25-44 years
(162.4 and 65.3, respectively) and persons aged 45-64 years (22.3
and 27.8, respectively). Among persons aged greater than 65
years, TB was the most commonly reported notifiable disease
(16.3). Age-specific data about chlamydial infections were not
available for 1995.

Editorial Note: The findings in the Summary of Notifiable
Diseases reflect only diseases that are diagnosed by health-care
or laboratory workers and reported to state and local health
departments, who then report to CDC. Resources available for
conducting surveillance vary widely by disease (3). In addition,
patterns of detection and reporting probably vary by disease, age
or population group, state, and locality. Consequently, for many
of these conditions, the true incidences in the United States
probably are underestimated. Despite such limitations, however,
these and other surveillance data are useful for monitoring
trends and for determining relative disease burdens.
As part of the MMWR series, CDC will release on October 25
the Summary of Notifiable Diseases, United States, 1995 (2). This
publication contains summary tables of the official statistics
for the reported occurrence of nationally notifiable diseases
during 1995. Data for 1995 are presented by month; geographic
location; and patient age, sex, and race/ethnicity in maps and
graphs for many conditions. Also included are a brief history of
notifiable disease reporting, highlights of important
developments in the reported occurrences of selected
nonnotifiable diseases (e.g., dengue fever, hantavirus pulmonary
syndrome, penicillin-nonsusceptible Streptococcus pneumoniae, and
Ebola hemorrhagic fever), and data from the Public Health
Laboratory Information System.

Last year, sexually transmitted diseases (STDs) represented
87 percent of all cases of the 10 most frequently reported
infectious diseases in the United States, federal researchers
report. According to the Centers for Disease Control and
Prevention, the 10 most prevalent infectious diseases in the
United States in 1995 were, in descending order: chlamydia,
gonorrhea, HIV/AIDS, salmonellosis, hepatitis A, shigellosis,
tuberculosis (TB), syphillis, Lyme disease, and hepatitis B.
Rates for HIV/AIDS and TB were significantly higher among men
than women, with more than four times as many AIDS cases
reported in men than in women, and twice as many TB cases.
"Questions on Ethics Lead to Review of Needle-Exchange Study"

Amid charges that a proposed needle exchange study in Alaska
is unethical, the National Institutes of Health announced
Thursday that it would review the plan. The $2.7 million,
three-year study at the University of Alaska at Anchorage was
slated to begin recruiting patients in December. The researcher
will attempt to determine whether injection drug users can reduce
their risk of viral infection by exchanging their used needles
and syringes for clean ones. The Washington-based Public
Citizens' Health Research Group said the study was unethical
because it would deny access to clean needles to half of the drug
users, those in the control group. A spokeswoman for the NIH
said that the study had been approved by two ethics boards, but
that it would be reviewed again soon. Dennis G. Fisher, the
researcher leading the study, has defended it. He pointed out
that the control group would be told where to go for needles and
how to get them. He explained the study design is necessary to
prove that needle exchanges work.
"Biotech Firms Find Structure of Protein for Hepatitis C"

Vertex Pharmaceuticals and Agouron Pharmaceuticals have
separately identified the structure of a protein necessary to the
reproduction of the hepatitis C virus, sparking a more intense
competition between the two to find a drug for the treatment of
hepatitis C. The discovery, published in separate articles in
the Friday edition of the journal Cell, provides a starting point
to develop a drug that would interfere with the protease that
helps the virus to replicate. The research builds on the success
of HIV protease inhibitors, but the hepatitis C virus protease
may well be a more difficult target than the HIV protease,
because its working end is "broader and more open," notes Agouron
CEO Peter Johnson. Analyst Rachel Leheny of Hambrecht & Quist,
meanwhile, predicts that an effective drug for the treatment of
hepatitis C could bring in $2 million to $3 million in annual
revenue.

Merck is introducing its AIDS drug Crixivan in the European
market, hoping to prevent "parallel trading" of the drug between
countries by selling the drug at a fixed price across the
European Union (EU). The legal practice of parallel trading,
buying goods in the cheapest EU states and selling them for
higher prices in other places, is opposed by drug companies
because it harms the market and denies patients a steady supply
of medicine. While pharmaceutical makers have opposed such trade
for years, they now have on their side AIDS activists, who are
demanding access to powerful new drugs like Crixivan. However,
EU officials have not yet been persuaded that parallel-drug
trading is as detrimental as the industry claims.
"Ten-Year-Old Fraud Suit Settled for $14.5 Million"

ICN Pharmaceuticals reports that it has settled a
10-year-old class action investor lawsuit for $10 million in cash
and $4.5 million in common stock. According to an attorney for
the plaintiffs, the suit alleged that ICN had defrauded investors
by making claims about possible effects on patients of its AIDS
drug ribavirin. A New York jury rejected seven of 13 claims made
in the case, but was deadlocked over the remaining six and a new
trial date needs to be scheduled. A spokesman for the drug maker
notes that the company "has consistently maintained that the
allegations upon which it was based were false."
"Hospitals Keep Drug Packs in Case of AIDS Accidents"
Toronto Globe and Mail (10/17/96) P. A7; Coutts, Jane
Hospitals in Toronto are starting to prepare for the
accidental exposure of health-care workers to HIV by keeping
drugs to treat such exposures on hand. The plan is based on
recommendations made by the U.S. Centers for Disease Control and
Prevention in July, which call for treating HIV-exposed workers
with a combination of antiviral drugs that includes a protease
inhibitor. Studies in the United States have found that
immediate treatment can reduce a worker's risk of developing AIDS
by 70 percent. The CDC recommends that the drugs, which cost
about $1,200 per person, are used only in very high-risk cases,
like a deep prick from a needle that has been used on an AIDS
patient. The agency said the level of risk should be balanced
against the effects of the drug. The government of British
Colombia has stocked every emergency room in the province with
five-day starter packs of the drugs, to be available for anyone
accidentally exposed to HIV.
"PM's Brother Testifies at Blood Probe"

Concerns about the possibility of HIV being transmitted
through the blood supply had diminished by 1987, testified Michel
Chretien, co-chairman of a study about the disease with Justice
Horace Krever in 1987-1988, on Wednesday. Chretien, the brother
of Canadian Prime Minister Jean Chretien, was called by the
province of Ontario to testify at the federal inquiry into the
country's tainted blood scandal. Ontario is one of the parties
that could be cited for misconduct in Krever's final report for
failing to take precautions to protect the blood supply from HIV.
The Ontario government called Chretien to show that little was
known about AIDS, or how to protect the blood supply, at the
time.
"Inside Politics: Dating Clinton"

Members of the AIDS Coalition to Unleash Power, or ACT UP,
have placed an ad in the Washington Blade, Washington, D.C.'s gay
newspaper, urging AIDS activists not to support President
Clinton. "He keeps toying with our affections. Do we really
want another date with this man?" asks the ad.
"Physicians Try Unusual Drugs to Fight Cryptosporidium"

Creative new therapies are being developed to treat
cryptosporidiosis, the diarrhea-causing infection for which nearly
100 potential drugs have been tried. NTZ, a drug initially
developed for dogs with worms, will enter final testing at the
National Institutes of Health in November. AIDS patients are
demanding the drug, and are importing supplies from Mexico, where
it is used to treat both humans and animals. Moreover, of the
first 29 U.S. AIDS patients given NTZ, one-third experienced at
least some benefit. UniMed Pharmaceuticals is offering NTZ to 150
patients as an experimental therapy. Another drug is being
developed using the milk produced by cows just after giving birth.
The mothers' antibodies are thought to attach to Cryptosporidium
and help block its spread through the intestines.
Meanwhile, the biotechnology firm GalaGen is pretreating 250,000
cows to increase their antibody production. About half of the 21
AIDS patients treated in initial testing have reported
significant declines in diarrhea. The Centers for Disease
Control and Prevention's Dan Colley noted, "We need to be
cautious," though "we clearly need to think outside the normal"
drug therapies, which have failed.
"Tosoh Says it Has Created Way to Count Viral Particles in Blood"

Tosoh Corp., a Japanese chemical maker, has developed a new
method for measuring the number of viral particles in a blood
sample. The test, which uses a special ion-exchange resin to
isolate viral genes, may be used to diagnose viral infections and
has the potential to be automated. The company has reported that
the test can detect as few as 100 viral particles and is able to
give a count if at least 10,000 particles are present. The new
assay has been successfully tested on blood samples that
contained HIV and cytomegalovirus, Tosoh said.

President Clinton has consistently fought to open up the
political process, toughen ethics codes for government officials,
and reform the nation's campaign finance laws. He has enacted
the most sweeping reforms in decades, and is pushing to go even
further.
THE RECORD:
Toughest ethics code ever. President Clinton imposed the
strictest administration ethics code ever to close the "revolving
door"-- including a lifetime ban on lobbying for foreign
governments, and a five-year ban on lobbying your own agency
after leaving government service. (January, 1993.)
Toughest lobbying reform in half a century. President
Clinton fought for and signed the Lobbying Disclosure Act -- the
toughest lobbying reform bill in 50 years. It requires lobbyists
to disclose who they work for, what they are spending, and what
legislation they are trying to pass or defeat. President Clinton
also closed the tax loophole for lobbying, ending the tax
deductibility of lobbying expenses for lobbyists and
corporations. (December, 1995.)
Banning gifts from lobbyists to lawmakers. President
Clinton pushed for and won a ban on gifts, meals and
entertainment from lobbyists to lawmakers. (Summer, 1995.)
Making Congress live under the laws it passes. President
Clinton pushed for and signed the Congressional Accountability
Act, to ensure that the same laws that apply to the rest of
America apply to Congress as well. (January, 1995.)
The Line-Item Veto. President Clinton pushed for and won
the line-item veto, allowing the President to eliminate wasteful,
special interest spending and tax breaks -- closing the door on
business as usual in Washington. (April, 1996.)
Expanding voter rolls through "Moter Voter." President
Clinton made it easier for more than 11 million Americans to vote
by pushing for and winning the National Voter Registration Act
("Moter Voter"). It has already created the greatest expansion
in voter registration since the 19th century. (May, 1993.)
Saving limits on campaign spending. President Clinton worked to
defeat the effort by Senators Dole and McConnell to effectively
end presidential spending limits by repealing public funding for
presidential campaigns. (May, 1995; May, 1996.)

PUSHING FOR BIPARTISAN REFORM:
Strongly endorsed McCain-Feingold bill to ban PAC's and
"soft money." President Clinton has publicly and repeatedly
urged passage of the bipartisan McCain-Feingold bill, to limit
campaign spending, end the "soft money" system, ban PAC's, and
give free and discounted broadcast time to open up the airwaves
to candidates. (February, 1996.)
Tried to appoint bipartisan commission with Speaker
Gingrich. President Clinton publicly shook hands and agreed with
House Speaker Newt Gingrich to appoint a bipartisan commission on
campaign finance reform, and asked two prominent Americans to get
the commission started, although the Speaker did not follow-up on
this agreement. (June, 1995.)

Your write-up looks great to me, the only real problem I think we face is
defining quality!
All of the reading I have been doing alludes to two aspects of health care
quality, something that is very subjective, (1) patient satisfaction with
treatment and (2) health outcomes (mortality, morbidity, functional status,
quality of life) for specific indications. What do you think of the
following?
quality: providing the necessary diagnostic tests and treatments that
already are known to lead to good health outcomes and that also satisfy
patient expectations.
I really like your expanded definition. It mirrors the background info I
compiled. I will try to work the two together by Thursday. I have
supported what you wrote with information on the number of individuals
under managed care today. I use cites from the extensive JAMA study
finding the impoverished and elderly have poorer physical and mental
health outcomes under managed care vs. FFS and the 1995 Common
Wealth Fund (an independent group) Study finding poor perceptions of
and satisfaction with care for low income managed care patients vs.
FFS patients. I also have a JAMA meta-analysis, cited by AAHP, that
finds no difference between managed care and FFS. I have included the
rate of conversion to managed care for Medicaid and Medicare. Finally, I
noted the current trends, both toward state legislation (400 new pieces
of legislation introduced this year) and toward increasing demand for
quality measures by sponsors, Medicare, and other purchasing agents.
Do you think this is too much??
I am hesitant to use the graph on page three - only because it brings up
problems with managed care that we are not really addressing, or that
we are not addressing at that level - such as directly addressing
preventative care. But I'm open. Off the cuff, I would be inclined to do a
similar chart using the three problems of managed care cited in the
problem definition.
Also, for our policy objective - I have come up with the following.
policy objective: To ensure a minimum level of quality care in the
managed care setting for all plan members.
Any thoughts?

Meg--the agenda looks good. One comment: we need to be careful
about how we articulate this issue -- we have only short-term data
on the impact of protease inhibitors. We certainly need to be
careful about not reopening the case definition at this time.
Two related issues we may want to raise:
(1) It would be useful to discuss what is happening with the DA&A
recertification process. There are many people with HIV who got
their original eligibility through DA&A but also need SSI because
of their HIV.
(2) About a month ago our office did a conference call between
client services managers of some of the AIDS service providers and
SSA to discuss the problems some of them are experiencing getting
presumptive eligibility for their clients. SSA is supposed to be
following up with some training and guidance for their field
offices. It would be good to get a status report.

The meeting on AIDS disability will take place in the New Executive Office
Building at 725 17th Str, NW in room 9104 from 2-4. The purpose for the
meeting is to discuss current disability policy with respect to AIDS and how
this might change given the protease inhibitors.
There will be representives from the White House Office of National AIDS
Policy, HCFA, SSA, ASPE, ASMB and OMB.
The agenda will include:
Clinical and Medicaid Policy Context
SSA statistics for People with AIDS (PWA)
How many people does SSA estimate will be on SSI and SSDI who are disabled due
to HIV/AIDS in FY 98?
How much will be spent on an aggregate basis in SSI and SSDI on the HIV/AIDS
population in FY 98? How much is spent on a per capita basis?
Please describe collaboration between HCFA and SSA in terms of AIDS policy and
baseline estimation.
Could SSA estimate the change in expenditures and enrollment of changes in
disability policy?
Current Disability Policy for People with AIDS
What are the current disability policies for AIDS?
Should AIDS still be considered a permanent disability leading to death or
should it be considered a nonperment disability, given the new Protease
Inhibitor drugs?
Please describe the continuing eligiblity review process for AIDS
beneficiaries. What is the periodicity of the reviews? How might this be
impacted by the changes in AIDS therapy (i.e. disability cycling)?
For how long are PWA typically eligible for SSI and SSDI? How often are
redeterminations actually done?
Current Work Incentive Policies
Please explain the policy allowing Medicare or Medicaid coverage to continue
after entitlement to SSDI or SSI ends.
How many people are using the 1619(a) and 1619(b) programs? How many could be
eligible for it who are not taking advantage of it? How many are HIV-postive?
What type of outreach is done to attract people into the 1619(a) and (b)

MEMORANDUM TO THE PRESIDENTIAL ADVISORY COUNCIL ON HIV/AIDS

SUBJECT: Assistance to Native Americans under the Ryan White
CARE Act
Many of you have expressed concern about the recent developments
regarding Federal assistance to organizations serving Native
American populations under the Ryan White CARE Act. My office
has worked closely with the Department of Health and Human
Services and the Health Resources and Services Administration to
resolve this issue.
For the past five years, the National Native American AIDS
Prevention Center (NNAAPC) has received assistance under the Ryan
White CARE Act through two grants awarded under the Special
Projects of National Significance (SPNS) program. These grants
have enabled NNAAPC to establish a network of case management
programs to serve Native Americans living with HIV. Earlier this
year, NNAAPC applied for a third SPNS grant but that application
was recommended for disapproval by an external peer review panel.
As a result, NNAAPC was not awarded one of the 19 SPNS grants
recently announced by HHS.
HHS, HRSA, and ONAP agreed that it was important to find ways to
continue to support the case management work being done by
NNAAPC. Through some very hard work by HRSA, a plan has been
developed to support NNAAPC and its 10 sites around the country.
While the details are still being sorted out with NNAAPC, the
following is the basic plan:

NNAAPC will be permitted to utilize $85,000 in unobligated
funds to support its center in Oakland and Oklahoma until
January 31, 1997;
HRSA will provide an additional $405,000 in transitional
assistance to NNAAPC to enable it to meet its contractual
obligations to provide case management services until
January 31, 1997;
In November 1996, HRSA will issue a Request for Applications
to "ensure the ongoing availability of services for Native
American communities to enable such communities to care for
Native Americans with HIV disease." A total of $1 million
will be made available for this RFA under the SPNS program.
An award or awards will be made on a competitive, peer
review basis in January 1997.
I want to thank Jeremy Landau and other members of the Advisory
Council who expressed concern about this matter and provided
assistance to this office, HHS, and HRSA in developing a
flexible, workable solution. I especially want to thank Carole
laFavor for her input, her determination, and her passion in this
matter.

Medicare/HIV study. I am happy to be the heavy on this -- but

Yesterday I attended a meeting convened by Brian Atwood,
Administrator of the U.S. Agency for International Development
(USAID). He made a commitment that the agency would address the
issues you raised in your resolution during the September
Presidential Advisory Council meeting.
Administrator Atwood underscored the importance of the HIV/AIDS
program and stated that it would continue to be an important
priority for the Administration. He also focused on the staffing
issue, noting that 9 of the 12 designated HIV/AIDS staff
positions had already been filled. The remaining three
positions, including that of Chief of the Division, are expected
to be filled by the end of the year.
I wanted to inform you of this progress.

Problem Statement:
There is increasing public debate about the apparent disparity
between the quality of health care offered by managed care
programs and traditional fee
-for
-service plans. There is
increased public pressure for the government to resolve this
problem.
What do we mean by managed care? We are essentially talking
about an approach that changes the financial equation between
provider and consumer. Under managed care plans, providers are
offered a flat fee -- known as a capitated rate -- to provide for
all the care an individual might need (with some exceptions);
under a traditional fee
-for
-service plan, providers are
reimbursed based on the services they provide. Put differently:
quote from Finkelstein, et al.:
Unlike traditional insurance, managed care combines the
roles of insuring against risk and arranging or providing
for the actual delivery of medical care. Under the
traditional insurance system, there was a clear distinction:
providers delivered care and insurance companies paid at
least a portion of the charge. Patients perceived that
physicians were focused primarily on treating their health
needs. Under the new system, providers generally work for
or are under contract with the managed care plan, which not
only acts as the insurer by bearing the risk; but also, sets
the rules under which care is delivered to patients.
Today's managed care patients may perceive that their
physician has two clients: the plan and the patient.
The trend toward managed care, in both public and private
settings, has been offered as a more efficient -- and less
expensive -- way to deliver health care. While the conversion to
managed care has sometimes been shown to reduce cost, there are
others who suggest this trend reflects that managed care
companies tend to have among their clients those who need less
costly forms of care. (For example, demonstration programs
putting Medicaid clients into managed care have usually excluded
those with disabilities.)
The number of people in managed care has increased dramatically
over the last several years. In 1991, 47% of those with
employment based insurance were in some form of managed care; in
1994 that increased to 65%. The increase is more profound in
Medicaid: 14% in 1993, 23% in 1994, xx% in 1995.
To repeat, the fundamental difference between managed care and
fee
-for
-service is the discretion given both patients and
treating physicians in choosing health care options. Managed
care plan managers define limits on treatment options (with
difficult appeals processes when patients or providers wish to
challenge it) and often offer providers financial incentives to
limit care. Because this is the only plan their employer offers
or their Medicaid program limits their switching options, the
capacity for individuals to switch plans based on dissatisfaction
with care is not a natural limit on the plans.
There are a number of studies suggesting problems in the quality
of health care delivered by managed care plans -- the most recent
being (cite JAMA), as well as consumer dissatisfaction with
managed care (Commonwealth Fund). While these have not gone
without challenge from the managed care industry, the perception
is firmly entrenched in the political arena that this is a
problem in the health care system -- even as public policy
continues to drive more people into managed care under both
Medicare and Medicaid.
To date, there have been several approaches taken to this
problem. At the state level, 33 states passed legislation
regulating HMOs in some way in the last year; New York State
passed a comprehensive consumer bill of rights; [add outcome of
CA initiative] and the Congress passed legislation restricting
one HMO practice setting minimum hospital stays for childbirth
to eliminate so
-called "drive by" deliveries. In addition, the
President has created an Advisory Council on Health Care Quality
and Consumer Protection [verify name], designed to address this
issue in a more comprehensive way.
This is a problem. It is more than perception, given the number
of studies that have suggested that there are better health
outcomes and greater consumer satisfaction (the two are not
necessarily the same) in fee
-for
-service plans than in managed
care plans. However, this runs up against a competing problem:
cost containment in the health care setting. Clearly any
analysis of this problem must be particularly cognizant of the
financial implications to the public and private sectors.
The options we will consider as potential strategies for
addressing this problem reflect different analyses for the cause
of the problem as well as different philosophies. For example --
is the disparity caused by a lack of competition among HMO
providers as there is among fee
-for
-service providers? Will an
ever increasing (and more middle class) population in managed
care provide a natural correction as they advocate for themselves
within the system? Is it a money problem -- do reimbursement
rates diminish quality? Is this a problem to resolve at the
federal or state levels?
