AMENDMENT To H.R. 3865, As REPORTED OFFERED By MR. APPLEGATE OF OHIO At the end of title III, insert the following new sec- tion: 1 SEC. 308. GENERAL ACCOUNTING OFFICE STUDY OF HAZ- 2 ARDOUS WASTE INCINERATOR. 3 (a) STUDY.-The Comptroller General shall conduct 4 a study of the manner in which the Environmental Protec- 5 tion Agency handled the hazardous waste permit applica- 6 tion for the commercial hazardous waste incinerator lo- 7 cated in East Liverpool, Ohio, with respect to which a per- 8 mit was issued with the Environmental Protection Agency 9 hazardous waste permit identification number 10 OH980613541. The Comptroller General shall submit to 11 Congress a report on such study not later than 6 months 12 after the date of the enactment of this Act. The report 13 shall include such recommendations as the Comptroller 14 General considers necessary for the Environmental Pro- 15 tection Agency to correct irregularities in the process by 16 which the permit was issued. 17 (b) PROHIBITION ON BURNING.-The Administrator 18 of the Environmental Protection Agency may not approve 19 a trial burn plan for the commercial hazardous waste in- 20 cinerator referred to in subsection (a) until such time as July 9, 1992 SENT BY:Xerox Telecopier 7021 11-24-92 ; 3:46PM ; 2022253719- :# 3 F:\M\APPLEG\APPLEG.003 H.L.C. 2 1 the Administrator implements all recommendations con- 2 tained in the report of the study conducted under sub- 3 section (a). 4 (c) CONSTRUCTION.-Nothing in this section shall be 5 construed as authorizing an investigation or review into 6 the merits of the commercial hazardous waste incinerator 7 referred to in subsection (a).
