August 4 Hearing on Global Climate Change
Joint Implementation
Please provide EPA's view on the advisability of including joint implementation actions as part
of the national action plan.
EPA supports inclusion of joint implementation in the Climate Change Action Plan, but only as a
pilot program at this stage. No eductions under the U.S. Initiative on Joint Implementation

(CoP) and accelerate development of criteria for joint implementation in accordance with Article
4.2(d) of the Framework Convention on Climate Change (FCCC).
Please explain how joint implementation efforts, if included as part of our national action plan,
could be adequately enforced and monitored.

EP A Shares your concern that no provisions currently exist, neither domestic nor international,
for monitoring and enforcement of joint implementation efforts. EPA is actively evaluating
concer
options for monitoring and verification of joint implementation actions. EPA expects these
with
issues to be taken up by the Intergovernmental Negotiating Committee as early as its next
meeting in February 1994. The official criteria for joint implementation may not be adopted until
state
after the convention enters into force and the CoP holds its first session (probably in early 1995).
Please explain whether any federal agency currently has adequate authority to monitor emission
levels, to oversee enforcement and to assure credible joint implementation actions.
EPA is not aware of direct authority in any federal agency to oversee enforcement or ensure
concern with
credibility of joint implementation actions. EPA expects these issues will be addressed through
the inter-agency U.S. Initiative on Joint Implementation (USLII) described in the Climate Change
state
Action Plan.
Please explain EPA's current views on the need for an international regime. Please also
explain who will bear liability for making up lost emission reductions in the event that it is
subsequently discovered, after, for example, a five-year period, that a joint implementation
project has not been properly carried out.

EPA strongly supports the development of "criteria for joint implementation" by the CoP in
accordance with Article 4.2(d) of the FCCC. Such criteria will be essential to ensuring fair,
credible, and effective joint implementation actions. A stable and widely accepted international
regime is essential to the realization of the long-term benefits of joint implementation.
EPA is evaluating the complex question of liability for failed joint implementation projects, but
is not ready to recommend a specific policy or position on the issue at this time. Because parties
to the convention are national governments (plus the EC), liability for joint implementation
projects could affect the emissions reduction commitments of participating nations. In assigning
liability, parties must also consider their communications requirements and financial obligations
under the convention. EPA

An additional concern is how we can assure that joint implementation does not provide credit for
steps that would have been taken in any case. Please provide your views on this matter.

secured through joint implementation will assure actual reductions in aggregate emissions. For
example, in the absence of a cap, is it not possible that some foreign countries might first
produce emission increases, and then take credit toward our greenhouse reduction targets -- and
actually gel paid U.S. dollars for reducing the amount of such increases. Please explain why
such a scenario, where joint implementation would actually create an incentive for countries to
increase emissions, is not plausible.
EPA is concerned that there will be incentives to boost projected emissions if joint
implementation is permitted with countries that do not have internationally rccognized emissions
targets against which to measure actions. For this reason, some parties to the convention believe
joint implementation should be allowed only among Annex 1 countries, all of which have an
emissions reduction target (effectively, a "cap" among those countries.)
Because important questions like this remain, EPA is strongly in favor the approach to joint
implementation adopted by the President in the Climate Change Action Plan. The U.S. Initiative
on Joint Implementation is intended to accelerate the international effort to develop criteria that
will eliminate incentives to increase emissions, while encouraging countries to participate and
/
strengthen their commitments to reduce emissions.

Are greenhouse benefits real for reforestation?
Forestry projects vary in the reliability and certainty of greenhouse gas reductions, depending on
their design. EPA feels most confident about the carbon sequestration benefits of tree planting
projects on crop or pasture lands (afforestation), or of reforestation of harvested stands. Standard
forestry yield tables compiled over decades offer highly reliable data on growth rates expected
for given species for given soils and location (known as "site class"). EPA and DOE analyses of
the benefits of urban tree planting are based on similar yield data for urban conditions, which are
fairly well known, and building-scale measurements of potential cooling and heating energy
savings from "strategic landscaping" (planting to shade residences and low buildings). Large-
scale reforestation outside the U.S. occurs in conditions that require more careful monitoring and
analysis to ensure that benefits actually occur and are not lost through deforestation. In all
situations, careful analysis and monitoring is needed to assess the extent of, or to prevent
"leakages" to other sites.
Does EPA favor granting credit for such carbon sequestration steps?

EPA has actively performed or supported analyses of the benefits of a wide range of carbon
sequestration projects in the U.S. The results of these studies over almost five years indicate that
the carbon benefits can be real, measurable, monitored, and can be included in the Climate
Change Action Plan. Protection and enhancement of sinks is a valid response measure to reduce
greenhouse gas accumulation in the atmosphere. EPA believes that emissions reduction
measures should be relied on as much as possible to meet USG commitments to stabilize
emissions, and that sink enhancement measures should also be pursued but counted toward
consult
stabilization in 2000 only when they are essential and reliable. In the context of the EP Act

Explain how reforestation initiatives would be monitored. Does EPA favor monitoring to assure
that trees are properly cared for? Will credits vary depending on how well trees develop? How
will credits be recovered if trees do not develop well or a die-off occurs?
EPA strongly favors counting credits as they accrue, based on prospective estimates but backed
up by on-site verification. EPA will work to develop detailed implementation guidelines and
periodic monitoring of all forest and non-forest greenhouse reduction projects or programs
included in the Climate Change Action Plan, Energy Policy Act Section 1605b guidelines, joint
implementation, and other processes. Forest projects in the U.S. could be monitored in several
ways. One approach might involve the use of standard forestry yield tables to cstimate forest
growth for new plantations under specific site conditions. Field inspections would measure
actual growth every 2-5 years, depending on the size of the plantation, costs, ownership, etc.
"Credits" could either be estimated from yield tables for the first years, and adjusted once field
monitoring occurs, or could simply be granted only after growth occurs and is verified.
Monitoring could be carried out by the project initiator, and verified by State Foresters, private
contractors, or USDA-Forest Service extension staff, using a combination of standard site visits
and aerial photography (similar to the USDA commodity crop monitoring program). These
procedures may need to be supplemented with modeling to gain confidence that no "leakages", or
shifting of emitting activities to other sites, have occurred.
Is it realistic to expect tree growth over the seven years between now and 2000 at levels
adequate to produce substantial greenhouse reduction gains?
Yes. EPA, USDA-Forest Service, and other analysts conclude that about half to several million
metric tonnes of carbon could be sequestered over this period, depending on the funding level
and efficiency of implementation. The Conservation Reserve Program of USDA accepted bids
from farmers for removal of cropland from commodity crop programs within one year after
announcement of the program. The Forest Service developed a substantially expanded
extension capability over three years to implement the America the Beautiful program
(minimally funded), now available for rapid start-up. Analyses show that growth rates in the
southern and central U.S. are substantial within 3-4 years, since plantations there often operate on
20- to 30-year rotations.
How can we be certain that nations undertaking reforestation might not engage in deforestation
at the same time credits are granted for tree planting? Describe safeguards to assure that
reductions are credible and enforceable.
The careful design of forest projects for carbon benefits outside the U.S. is critical to ensure
benefits. Project designs will need to consider the need to isolate project impacts from
background land use changes, to clearly demonstrate benefits. Projects enhancing supply of
forest products in sustainable management regimes (e.g., afforestation of degraded or abandoned
lands) may be more likely to produce easily measured and monitored benefits than projects that
change harvest methods or reduce deforestation, for example. Several projects funded by U.S.
electric utilities have attempted to minimize leakage of carbon (e.g., forest conservation by a

project simply displacing harvest outside the project area) by locating projects adjacent to
national parks, in areas without other forests, or in other ways that somewhat isolate them from
broader markets for land and forest products.
EPA has begun work adapting a dynamic computer model of land use changes to address
evaluation of this leakage problem. We will evaluate the certainty and magnitude of benefits of
5-10 existing international carbon forestry projects using this dynamic approach to land use
analysis. Last, remote sensing by aerial photography or satellite imagery is likely to be necessary
to monitor project land uscs, changes, and displacement. In sum, EPA recognizes the difficulty
of evaluating international projects, and the uncertainties of socioeconomic change on
greenhouse benefits, but is working to develop adequate monitoring and evaluation techniques.
Milestones
Does EPA favor inclusion of interim points in the action plan at which progress will be
evaluated, with contingency measures to be put in place quickly if interim assessments show that
we are going to come up short of our greenhouse reductions target in the year 2000? Does EPA
favor inclusion of such a step in any future international agreement?
It is my view that such a milestone program analogous to the provisions for assuring progress
toward meeting ambient air quality standards in section 182((g) of the Clean Air
Act is essential. If EPA does not favor inclusion of such a safeguard, please explain how, in
the absence of such a structure, the Administration can assure the credibility of a plan that relies
upon models and economic projections, as well as on voluntary measures that may not be
implemented us expected.

Under Article 12 of the FCCC, each Annex 1 Party is required to report, "for all greenhouse
gases not covered by the Montreal Protocol":
"a national inventory of [emissions and sinks]";
"a detailed description of its policies and measures"; and

"a specific estimate of the effects that policies and measures will have on [emissions
and sinks] of greenhouse gases".
Congress has already given EPA primary responsibility for developing climate policy and
preparing greenhouse gas emissions inventories. EPA expects to have a leading role in the
development of periodic assessments of the effects of climate change policies and measures, but
existing authorities are vague vague

With proper authorities from Congress, EPA could establish a program to periodically assess the
impacts of policies and measures in accordance with the requirements of the FCCC. Such an
assessment could be coordinated with EPA activities on inventories, national policies and
measures, and communication with the INC/CoP.

Inventories
At the hearing, it was explained that a new effort is being undertaken to coordinate ongoing EPA
and DOE efforts related to the compilation of accurate inventories of greenhouse gases. Please
describe the process by which the data which DOE collects from voluntary submissions, as well
as the inventories based on existing data at the Energy Information Administration, is forwarded
for consideration in EPA's compilation of broad inventories of greenhouse air pollutants.
I urge that DOE and EPA coordinate fully as each undertakes its statutory responsibility,
leading ultimately to comprehensive inventories for each greenhouse pollutant. Such
coordination is especially important as we prepare to move forward into an era where these
inventories will be essential to the implementation of new programs to address the global climate
issue.
EPA and DOE have agreed to work together to meet our respective greenhouse gas emissions
inventory obligations. We are preparing a Memorandum of Understanding between the two
agencies to outline our joint commitments and to avoid duplicating efforts. We have reviewed
each other's methods and data sources. At this point, we anticipate that some minor, but
explainable differences will remain between the two inventories. The EPA inventory is being
developed to be consistent with internationally agreed guidelines and will serve as the official
U.S. greenhouse gas inventory to meet reporting requirements under the Climate Convention.
The DOE inventory uses slightly different methods that provide greater levels of sectoral detail.
However, in aggregate, the differences between the two inventories are less than one percent.
These differences will be reduced as EPA and DOE continue to review and reflect on each other's
methods. Reports will provide cross-walks between the different formats. EPA hopes to
establish
EPA and DOE have also agreed to work together to establish guidelines for reporting voluntary
emissions reductions and to establish an cmissions reductions recognition program. EPA and
DOE will share the information collected under the voluntary reporting program. It will
supplement CO₂ monitoring data collected by EPA under the CAAA and be used to enhance the
national inventory and measurement of progress Climate Change Action Plan. At this point,
neither EPA nor DOE have plans for incorporating these data into the national aggregate
inventories of greenhouse eas emissions

Scope of the Commitment
In his Earth Day speech, President Clinton pledged to "continue the trend of reduced emissions"
after the year 2000. In testimony last month before the Senate Energy Committee, Secretary
O'Leary explained that at a minimum this pledge means that emissions after the year 2000 will
not rise above 1990 levels. Please explain [whether] EPA agrees with this view.
EPA agrees with the President's statement that the Climate Change Action Plan will continue the
trend of reduced emissions after the year 2000.

The policies proposed Climate Change Action Plan will continue help reduce greenhouse
gas emissions from projected levels beyond the year 2000. The Action Plan also establishes a
working group to develop policies that will provide additional long-term emission reductions,

of the year will help continue the trend of reduced emissions.
