/ HOUSE BILL SENATE BILL COMMENTS I grams or loans described in paragraph (1)(A) in any 2 Federal or State court, or other tribunal, and such 3 optically imaged copy shall be admissible in any 4 court or tribunal of the United States or any State 5 as if such copy were the original document or record 6 and have the same force and effect as the original. 7 "(3) CONSTRUCTION.-(A) Nothing in this sub- 8 section shall be interpreted to preclude the admissi- 9 bility of a duplicate of a document or record re- 10 quired for the administration of the programs or 11 loans described in paragraph (1)(A) made by a tech- 12 nology other than optical imaging consistent with 13 the Federal Rules of Evidence and section 1732 of 14 title 28, United States Code, or applicable State law. 15 "(B) Nothing in this subsection shall be inter- 16 preted to preclude the admissibility of an optically 17 imaged copy of any document or record in a pro- 18 ceeding outside the scope of this subsection consist- 19 ent with the Federal Rules of Evidence and section 20 1732 of title 28 of the United States Code, or appli- 21 cable State law.". 22 (b) OPTICALLY IMAGED DOCUMENTS.-Section 432 23 of the Act (20 U.S.C. 1082) is amended by adding at the 24 end the following new subsection: 25 "(q) OPTICALLY IMAGED DOCUMENTS:-Records 26 maintained in accordance with section 484A(c) may be 27 used in any proceeding as nermitted by section 484A(c).
