Public facility means any building regularly entered by 10 or more individuals at least one day per week, including any such building owned by or leased to a Federal, State, or local government entity. It also includes outdoor stadiums or arenas used for sports, entertainment, or other events that may be used less than one day per week. Public facilities do not include any building or portion thereof regularly used for residential purposes. Smoking should be prohibited in all areas (indoors and outdoors) of elementary and secondary school campuses. Transit Smoking should be prohibited on any plane, bus, or train traveling within the United States and on any U.S. owned carriers, including cruise ships, originating in or arriving at any point in the United States. Enforcement The Administrator of the EPA should be authorized to promulgate regulations as the Administrator deems necessary to carry out the restrictions on environmental tobacco smoke. These regulations should include enforcement authority for the agency, as well as for state and local authorities. Preemption The ETS provisions must be expressly non-preemptive. Nothing in the legislation shall preempt or otherwise affect any other Federal, State or local law which provides protection from health hazards from environmental tobacco smoke. Public Education Efforts The public education efforts on tobacco should include campaigns designed to educate the public regarding the hazards of environmental tobacco smoke in worksites, other public places, and homes. Particular efforts should be directed at discouraging smoking around children and pregnant women and discouraging smoking inside homes that include children. Research Funding for research should include funds for continued research on the health and economic effects of ETS. ETS Restrictions Can Improve Public Health: Health Problems and Costs Reduced Strong clean indoor air ordinances are linked with decreased cigarette consumption and smoking prevalence and reductions in employees' ETS exposure.¹⁴ EPA estimates that eliminating ETS exposure in the workplace would save between $35
