Dear President Clinton:
We are writing regarding your opposition to the "no immunity" amendment sponsored by Senator Leahy and Senator
Gregg to the national tobacco control legislation (S. 1415). We strongly disagree with your position on this amendment.
Now that the Senate has gone on record as opposing special protections for the tobacco industry. we hope that we can all
work toward creating a bill that protects kids and not the special interests of Big Tobacco.
Our position remains solid: we will not support any legislation that grants any special protections to the tobacco industry.
Special protections are unfair to Americans who are or will become sick with tobacco-related illnesses. Protection of an
industry whose products kill hundreds of thousands of Americans prematurely every year is fundamentally bad public
policy. Liability caps and other special protections allow the companies to escape full responsibility for their actions and
may leave many Americans without an adequate remedy in their already tragic situations. Additionally, an annual cap
would set a terrible precedent. Asbcstos companies, breast implant manufacturers. automobile makers, pharmaceutical
companies - who will be next? If the tobacco companies get their liability cap through Congress. other industries will
line up on Capitol Hill asking for similar deals.
We also would like to address your contention that the passage of the Gregg-Leahy amendment will make the tobacco bill
more vulnerable to defeat. We disagrec. First and foremost, the attempt to table the Gregg-Leahy Amendment failed by
a considerable margin. It is clear that the majority of U.S. Senators believe that granting special protections to the tobacco
industry is wrong. While a few of those Senators may oppose passage of the legislation, the clear majority voted with the
best interests of public health at heart. The large number of votes for the Gregg-Leahy amendment coupled with the
overwhelming defeat of the Ashoroft amendment to eliminate tobacco prices increases demonstrates that the majority of
the Senate will vote for the tobacco legislation that does not give any special protections to the industry.
Mr. President, we urge you to drop your opposition to the Gregg-Leahy Amendment and work with the public health
community. to hold the tobacco industry accountable for its actions.
