SUBJECT: Proposed Statement on Liability
Attached is the latest version of the position on liability on which we have been working.
Dr. Koop has been reviewing these drafts in total confidence. The last several drafts are
heavily influenced by his comments. He has last seen Draft # 3 (which I am enclosing) and
said he substantively thought it was good, but had one or two more minor edits. The other
changes from Draft # 3 to Draft #4 reflect Bill N.'s comments.
I have been seeking a careful balance between taking a strong moral stance and
accurately reflecting our position that any bill must be measured by its overall public health
impact. The message is sophisticated, but honest If we can put the internecine battles behind
us so that we can actually discuss public health without scaring members of Congress off, then
I think this is seriously worth considering.
Dr. Koop has specifically said he wants to play a unifying role and believes this
statement can help do that. He knows that the draft hasn't even been approved by the National
Center, let alone anyone else. He has said that if the statement does accurately reflect what
we are willing to say, then he would hope that we could hold a joint press event to talk about
what we favor and to say that there is no great division in the public health community.
