otherwise in accordance with the requirements of

this section bears a tobacco product brand name

(alone or in conjunction with any other word) or any

other indicia of tobacco product identification and is
19
disseminated in a medium other than newspapers,

magazines, periodicals or other publications (whether
21
periodic or limited distribution), nonpoint-of-sale
22
promotional material (including direct mail), point-
23
of-sale promotional material, or audio or video for-
24
mats delivered at a point-of-sale; but
