(B) MINIMUM STANDARDS.-In order for

an Indian tribe or tribal organization to assume

responsibility for the licensing and regulation or

(3) IMPLEMENTATION BY THE SECRETARY.-If

the Secretary, in consultation with the Secretary of

the Interior, determines that the Indian tribe or
21
tribal organization is not qualified to administer the
22
relevant requirements of the Federal Food, Drug,
