under this paragraph shall include at least 250

random, unannounced inspections of retail sale
4
outlets annually for each 1,000,000 persons
5
resident in the State, as most recently deter-
6
mined by the Bureau of the Census. Such in-
7
spections shall cover a range of outlets (not
8
preselected on the basis of prior violations) to
9
measure overall levels of compliance as well as
10
to identify violations, and shall be conducted to
11
provide a probability sample of outlets. The
12
sample must reflect the distribution of the pop-
13
ulation under the age of 18 years throughout
14
the State and the distribution of the outlets
15
throughout the State accessible to youth. Indian
16
tribes shall conduct such inspections monthly of
17
at least 1 retail outlet subject to their jurisdic-
18
tion for each 4,000 reservation residents. Ex-
19
cept as provided in this paragraph, any reports
20
required by this paragraph shall be made pub-
21
lic. As used in this paragraph, the term 'outlet'
22
refers to any location that sells at retail or oth-
23
erwise distributes tobacco products to consum-
24
ers, including to locations that sell such prod-
25
ucts over-the-counter."
