None of the funds appropriated by this Act may be used to withhold substance abuse funding
from a state pursuant to Section 1926 of the Public Health Service Act if such state agrees to
commit additional state fonds Excenforeement of state laws prohibiting sales of tobacco products
to individuals under the age of 18: Provided, that such state commit an amount of funding equal
to the amount of its substance abuse block grant allocation multiplied by the percentage by which
the state misses its retailer noncompliance rate goal unless the Secretary of Health and Human
Services agrees to a smaller commitment: Provided further, that such state funds supplement and
not supplant current funding dedicated to enforcement of such state laws.
