Comments should urge that each of these requirements be retained. Proposed section 273.2(b)(2) contains a list of requirements for state application forms, but these do not include information about the availability of, and importance of, the right to apply without delay. Instead, the proposed rules would merely require states to "make available advisory materials" with this information. Proposed 7 C.F.R. § 273.2(b)(2). This information could be buried in the middle of long, detailed pamphlets or hand-outs that also cover numerous matters involving food stamps and other programs. Even for the few households that may read such materials, the clear message likely will often be lost. Comments should urge that the final rules require that this information be provided on the application form or on a single-page leaflet distributed with that form. B. Encouraging or Discouraging Applications The proposed rules also would delete the requirement that states shall encourage a households to file an application on the same day the household first contacts the office seeking assistance. Current 7 C.F.R. § 273.2(c)(2)(i). Proposed section 273.2(c)(2) would maintain the requirement to encourage households to apply for food stamps - and, indeed, would broaden it to apply to all households contacting the office about financial difficulties whether or not they mention food stamps - but would delete the requirement that households be encouraged to file "the same day." In addition, the regulations would define the food stamp office's obligation to encourage the filing of an application as requiring only that it mention the Food Stamp Program and the household's right to apply. Thus, after mentioning those items, a receptionist or eligibility worker could recite a "diversion" speech designed to discourage households from applying for welfare benefits or could tell the household that in order to apply that day, it would be required to wait hours to see an eligibility worker. Comments on this issue should: C support the retention of the food stamp office's obligation to encourage applications and its broadening to cover circumstances in which the prospective applicant does not explicitly mention food stamps; C urge that food stamp offices continue to be obliged to encourage same-day filing 7
