We agree with the commenters and are amending paragraph (j)(2) to incorporate into current regulations much of the Department's July 14, 1999, guidance on categorical eligibility. Under the new requirements, households that meet the following requirements would be categorically eligible: (1) households in which all members receive or are certified to receive cash through a program funded in full or in part with Federal money under Title IV-A or with State money counted for maintenance of effort (MOE) purposes under Title IV-A; (2) households in which all members receive or are certified to receive non-cash or in-kind services from a program that is more than 50 percent funded with Federal money under Title IV-A or State money counted for MOE purposes under Title IV-A and that requires participants to satisfy a means test; and (3) households in which all members receive or are authorized to receive SSI benefits. Also, State agencies have the option to extend categorical eligibility to the following households if doing so will further the purposes of the Food Stamp Act and if State agencies get prior FNS approval: (1) households in which all members receive or are certified to receive non-cash or in-kind services from a program that is less than 50 percent funded with Federal money under Title IV-A or State money counted for MOE purposes under Title IV-A which require participants to satisfy a means test; and (2) households in which all members receive or are certified to receive cash, non-cash, or in- kind services through a PA program funded in full or in part with Federal money under Title IV-A or with State money counted for MOE purposes under Title IV-A which does not require participants to satisfy a means test.
