    "ocrText": "LEXIS®-NEXIS® View Printable Page\nhttp://web.lexis-nexis.com/In.universe/search/submitViewTagged\nLEXIS PUBLISHING'S CODE OF FEDERAL REGULATIONS\nCopyright © 2000, LEXIS Publishing\n*** THIS SECTION IS CURRENT THROUGH THE JUNE 26, 2000 ISSUE OF ***\n*** THE FEDERAL REGISTER ***\nTITLE 45 -- PUBLIC WELFARE\nSUBTITLE A -- DEPARTMENT OF HEALTH AND HUMAN SERVICES\nSUBCHAPTER A -- GENERAL ADMINISTRATION\nPART 98 -- CHILD CARE AND DEVELOPMENT FUND\nSUBPART C -- ELIGIBILITY FOR SERVICES\n45 CFR 98.20\nPHOTOCOPY\n§ 98.20 A child's eligibility for child care services.\nPRESERVATION\n(a) In order to be eligible for services under § 98.50, a child shall:\n(1)(i) Be under 13 years of age; or,\n(ii) At the option of the Lead Agency, be under age 19 and physically or mentally incapable of caring for\nhimself or herself, or under court supervision;\n(2) Reside with a family whose income does not exceed 85 percent of the State's median income for a\nfamily of the same size; and\n(3)(i) Reside with a parent or parents (as defined in § 98.2) who are working or attending a job training\nor educational program; or\n(ii) Receive, or need to receive, protective services and reside with a parent or parents (as defined in §\n98.2) other than the parent(s) described in paragraph (a)(3)(i) of this section.\n(A) At grantee option, the requirements in paragraph (a)(2) of this section and in § 98.42 may be\nwaived for families eligible for child care pursuant to this paragraph, if determined to be necessary on a\ncase-by-case basis by, or in consultation with, an appropriate protective services worker.\n(B) At grantee option, the provisions in (A) apply to children in foster care when defined in the Plan,\npursuant to § 98.16(f)(7).\n(b) Pursuant to § 98.16(g)(5), a grantee or other administering agency may establish eligibility\nconditions or priority rules in addition to those specified in this section and § 98.44 so long as they do\nnot:\n(1) Discriminate against children on the basis of race, national origin, ethnic background, sex, religious\naffiliation, or disability;\n(2) Limit parental rights provided under Subpart D; or\n19 of 72\n7/13/2000 12:40 PM"
