At a minimum, the summary shall include facts showing:\n(1) How a choice of the full range of providers, e.g., center, group, family, and in-home care, is made\navailable;\n(2) How payment rates are adequate based on a local market rate survey conducted no earlier than two\nyears prior to the effective date of the currently approved Plan;\nwhats date? the effective\n(3) How copayments based on a sliding fee scale are affordable, as stipulated at § 98.42.\n(c) A Lead Agency may not establish different payment rates based on a family's eligibility status or\ncircumstances.\n(d) Payment rates under paragraph (a) of this section shall be consistent with the parental choice\nrequirements in § 98.30.\n(e) Nothing in this section shall be construed to create a private right of action.\nHISTORY:\n[57 FR 34413, Aug. 4, 1992; 63 FR 39936, 39988, July 24, 1998]\nAUTHORITY:\nAUTHORITY NOTE APPLICABLE TO ENTIRE PART:\n30 of 72\n7/13/2000 12:40 PM"
