It was agreed that:
The USG should avoid an outcome in Kosovo that would result in
a partial withdrawal of FRY forces and the effective portion
of Kosovo. (Action: All) )
The USG will urge the French to complete work on the OPLAN for
KFOR, assuring them of our intention to seek a UN Security
Council resolution on KFOR and recalling that the OPLAN will
not be implemented unless NATO authorizes an Activation Order
(ACTORD) (Action: State) (8)
The USG will seek to modify the UN Security Council resolution
drafted by G-7 political directors to:
make reference to the military-technical agreement being
concluded between COMARRC and FRY authorities;
provide an exemption from UN Security Resolution 1160 for
arms and related equipment to be provided to the new local
Kosovo police;
make no reference to duration of the international civil
and security presences or, as a fallback, link their
termination to a final political settlement or an
affirmative decision by the Security Council. (Action:

The USG will work with UNHCR to initiate an information
campaign designed to discourage precipitous returns of
refugees to Kosovo so as to facilitate KFOR deployment and
ensure that refugees can return safely. (Action: State,

The USG will promote the coordination of planning between NATO
military authorities and UNHCR with respect to refugee
returns. (Action: State, DOD) (C)
The USG will produce an assessment of how many refugees can
safely return and be sheltered in Kosovo by this winter.

The USG will ensure to the extent possible that its planning
for humanitarian assistance can accommodate either the early
return of refugees to Kosovo following Belgrade's acceptance
of NATO's conditions or their continued accommodation outside

DOD will examine the feasibility of military air drops of
humanitarian rations and other essential supplies to IDPs in
Kosovo during the initial phase of KFOR deployment. (Action:

Your Phone Call to Blair
I attach talking points for your phone call to Prime Minister
Blair. Madeleine just met with the "quint" Ministers in Bonn,
where they agreed on the text of a UN Security Council
Resolution for Kosovo. She has now joined in a G-8 meeting with
Foreign Minister Ivanov, where the allies hope to secure Russian
support for the resolution. In the past, the Russians have
objected to many parts of the allied draft, particularly those
dealing with the authorities of KFOR. The ongoing session will
be a test of Russian "good faith" in wanting to bring the
current crisis to closure on terms that meet NATO's conditions.
If the Russians agree to an acceptable resolution, we will
quickly move it to the UN Security Council and use that and
Russian pressure on Milosevic to get Belgrade to accept the
Military-Technical Agreement tomorrow. Our objective would be
to have Serb withdrawals, NATO pause, UNSCR adoption and KFOR
deployment (ACTORD) take place in a tight sequence starting
tomorrow and ending Tuesday.
If, however, the Russians prove to be obstreperous, and
Milosevic maintains his position, we will have little choice but
to re-escalate the bombing campaign until he is ready to meet
NATO's conditions fully.

If the Russians are acting in good faith, we can forward a
resolution text to the UN Security Council tonight which could
help pave the way for conclusion of a Military Technical
Agreement tomorrow. This would provide for a rapid sequence
of events: withdrawal, suspension, adoption of a resolution,
deployment of KFOR (ACTORD)
If, however, the Russians are stalling in an effort to
undercut the Ahtisaari agreement and the role of NATO, we will
have little alternative but to re-intensify air strikes. We
need to work hard with the allies to prepare them for this
contingency.

In his New York Times April 6 editorial (Tab A), Thomas Friedman
suggested that the Serbs might be satisfied with a deal that
gave them the ten percent sliver of territory in northwest
Kosovo that, according to Friedman, contains their Orthodox
monasteries and holy sites.
Friedman's contention that a simple line in northwest Kosovo
could encompass all the Serb holy places is incorrect. The
revered battlefield of Kosovo Polje lies far to the east near
Pristina; other significant sites are scattered throughout the
province. As you can see from the map at Tab B, enclosing all
or even most of these sites would require more than ten percent
of Kosovo territory.
The map also illustrates that any partition plan would be
further complicated by the fact that there is no simple division
between areas of ethnic Serb and Albanian settlement. Moreover,
important economic sites, which Serbs would be reluctant to give
up, are located throughout Kosovo.
Finally, ethnic Albanians would oppose partition, as both
moderate leaders and the Kosovo Liberation Army insist on
independence for all of Kosovo. Partition would violate the
international proscription on changing borders in Europe by
force, as enshrined in the 1975 Helsinki Final Act.

Purpose
Respond to Senator Dorgan regarding the Milosevic indictment.
Background
Senator Byron Dorgan wrote condemning Slobodan Milosevic's
unconscionable brutality in Kosovo and urged your support of
ICTY in its efforts to indict, apprehend and punish war
criminals. He urged you to make this a priority among our aims
in the Kosovo conflict.
In your reply, you note that you are heartened by Justice
Arbour's recent announcement of Milosevic's indictment. You
further explain, as you did in Florida, your Administration's
strong support for ICTY's work, which includes information
sharing and funding. You note that NATO will not rule out
future contacts with Milosevic should he meet the non-negotiable
conditions.

Dear Byron:
Thank you for your letter on Kosovo. I deeply appreciate your
thoughts. I entirely agree with you about the need to hold
accountable those responsible for ethnic cleansing in Kosovo. I
know you were as heartened as I was by Justice Arbour's
announcement of the indictment of Milosevic and his associates
for crimes against humanity and other war crimes. The
indictment sends a clear message: those who order such brutal
crimes will not do so with impunity.
I want you to know that the United States supports the work of
the Hague Tribunal more than any other nation. For six years,
this support has been unstinting. While the Tribunal is an
independent body, we have urged it to pursue its investigation
of war crimes in the former Yugoslavia as far up the chain of
command as the evidence leads. We have also helped to provide
that evidence. We will continue to assist the ICTY's Office of
the Prosecutor as it solidifies the case against Milosevic by
providing as much relevant information as we can.
I appreciate Congress's resolute action in approving my request
for supplemental funding for the Tribunal. This will help
greatly in our efforts to deepen and intensify our support for
the Tribunal.
It is important to note that the indictment has no effect on
NATO's conditions. Milosevic and those around him know what
needs to be done to meet NATO's conditions. While these
conditions are non-negotiable, we do not rule out future
contacts if they are necessary to achieve our objectives and
further our interests. But ultimately, we want to see him in
The Hague for a fair trial.

Dear Mr. President:
I have supported the air strikes that the United States and NATO have launched against Mr.
Milosevic and his troops, who have been conducting ethnic cleansing, genocide, and other
unspeakable horrors against the Albanians in Kosovo.
As the air strikes have continued and negotiations with the Russians serving as
intermediaries have begun, I have become concerned that this conflict may be resolved without
holding Mr. Milosevic accountable for his despicable actions.
In short, any negotiated settlement to this conflict that allows Mr. Milosevic to remain in
power is a tragic mistake that would undermine the basis for NATO engagement in the Balkans.
For this reason, I have been insisting that the United States and NATO countries use their
influence to have Mr. Milosevic indicted and tried before the International Criminal Tribunal for the
former Yugoslavia (ICTY) to answer for his crimes. I do not understand the reluctance of the
United States or the NATO countries to aggressively pursue that as a primary objective.
Mr. President, I will only continue support for these air strikes if our policy is to bring Mr.
Milosevic to justice and hold him accountable before the ICTY for the unspeakable war crimes he
and his troops have committed against the Albanian Kosovars. In my judgement, negotiating a
settlement with Mr. Milosevic that leaves him in power and fails to prosecute him as a war criminal
would be an abysmal failure of the efforts of the United States and NATO to end the suffering and
repression of the Albanian Kosovars.
I am introducing legislation in the U.S. Senate today calling on your administration to
aggressively support the prosecution of Mr. Milosevic as a war criminal. I hope the Congress will
pass that resolution soon. Regardless of the outcome, however, I will not support continued air
strikes if the United States and NATO don't demand that Mr. Milosevic be held accountable. He
must be held up as an example to the world that we are tireless in our pursuit of justice.

Dear Jim:
Thank you for your letter on Kosovo and your insightful point
about Milosevic's reluctance to return to the negotiating table.
You are absolutely correct that he would prefer a UN regime,
similar to the UNPROFOR deployed in Bosnia from 1992-1995.
We are insisting on an international security force, with NATO
at its core, in order to insure the safe return and security of
the Kosovar refugees who have so brutally been driven from their
homes and livelihoods. I am convinced that only a NATO-dominant
force, together with Russian and other third-country
participation, will ensure adherence to the demands we have set
forth. From events of the past couple of weeks, I believe we
are coming closer to achieving our objective.
I share your hope that in the wake of the recent NATO Summit our
renewed military and diplomatic strategies will facilitate a
path to a negotiated settlement. In the meantime, I appreciate
your constructive recommendations on this issue.

Purpose
Respond to a letter from James Forman.
Background
James Forman wrote to suggest that given Milosevic's adamant
refusal to accept NATO troops as part of a Kosovo settlement,
that we accept UN troops for this purpose instead. In reply,
you thank him for the recommendation and reiterate our
preference for an international security force with NATO at its
core.
RECOMMENDATION

From various reports it seems the main reason Slobodan Milosevic is
refusing to agree to the cessation of hostilities in Kosovo is the NATO proposal to
