Department of State PROPOSED LETTER Same letter to be transmitted to: Speaker of the House Chairman, SFRC and Ranking Minority Member Chairman, SAC and Ranking Minority Member Chairman, SACFO and Ranking Minority Member Chairman, HIRC and Ranking Minority Member Chairman, HAC and Ranking Minority Member Chairman, HACFO and Ranking Minority Member Dear : Pursuant to section 652 of the Foreign Assistance Act of 1961, as amended ("the Act"), I wish to inform you that the President proposes to exercise his authority under section 552 (c) (2) of the Act to authorize the drawdown of up to $800, 000 in commodities and services from the Department of Defense to provide assistance to the Organization for Security and Cooperation in Europe's (OSCE) Kosovo Verification Mission (KVM). As indicated during the course of informal consultations with committee staff, and as described in detail in the enclosed memorandum of justification, we believe that this assistance is urgently needed to provide communications support to the KVM so that it may fully engage in its verification duties in Kosovo. Sincerely, Barbara Larkin Assistant Secretary Legislative Affairs Enclosure: Memorandum of Justification JUSTIFICATION FOR DRAWDOWN UNDER SECTION 552 OF THE FOREIGN ASSISTANCE ACT TO SUPPORT THE ORGANIZATION FOR SECURITY AND COOPERATION IN EUROPE AND ITS KOSOVO VERIFICATION MISSION As a result of the agreement signed between the government of the Federal Republic of Yugoslavia and the OSCE on October 16 of last year, an OSCE-led KVM will be replacing the U.S.-led KDOM on the ground in Kosovo. The transition from one to the other has already begun to take place, but in order to ensure that this transition is successful, the new mission must have functioning communications equipment in place very quickly. A portion of DoD funds made available to the Department of State at the time KDOM was undertaken was used to buy communications equipment. In light of the KVM's need for immediate communications capabilities, the Departments of State and Defense, following consultation with the OSCE, decided that it would make more sense to transfer this equipment to the KVM in a drawdown. This drawdown has been made necessary because it was not possible to anticipate or budget for the violence in Kosovo over the summer months that drove thousands from their homes. Ensuring that peace holds in Kosovo requires that we move immediately to support OSCE and KVM. For these reasons, the President intends to authorize the drawdown under section 552 (c) (2) of the Foreign Assistance Act of 1961, as amended, to provide commodities from DoD inventories and resources assistance to the OSCE's Kosovo Verification Mission so that it may perform its mission and contribute to a peaceful solution to the crisis in Kosovo. Doing so is important to the national interests of the United States. Presidential Determination No. MEMORANDUM FOR THE SECRETARY OF STATE THE SECRETARY OF DEFENSE SUBJECT: Drawdown of Commodities and Services under Section 552 (c) (2) of the Foreign Assistance Act of 1961, as Amended, from the Department of Defense to provide assistance to the Organization for Security and Cooperation in Europe to support the Kosovo Verification Mission Pursuant to the authority vested in me by section 552 (c) (2) of the Foreign Assistance Act of 1961, as amended, 22 U.S.C. 2348 (c) (2) ("the Act"), I hereby determine that: (1) as a result of an unforeseen emergency, the provision of assistance under Chapter 6 of Part II of the Act in amounts in excess of funds otherwise available for such assistance is important to the national interests of the United States; and (2) such unforeseen emergency requires the immediate provision of assistance under Chapter 6 of Part II of the Act. I therefore direct the drawdown of commodities and services from the inventory and resources of the Department of Defense of an aggregate value not to exceed $800,000 to provide assistance to the Organization for Security and Cooperation in Europe to support the Kosovo Verification Mission. The Secretary of State is authorized and directed to report this Determination to Congress and to arrange for its publication in the Federal Register.
