Robinson indictment or convictions, 18 U.S.C. 1952A. Guidelines
Section 2A2. (a) has always been applicable to those statutory
violation counts.
In addition, there are other requirements of law and statements
of fact that support Robinson's contention that the sentencing
guidelines were misapplied in this case. For example:
1 - U.S.S.G. 1B1.11(b)(2), the so-called "One Book Rule,"
became effective law on November 1, 1992. This sentencing guideline
rule dictates that "The Guideline Manual in effect on a particular
date shall be applied in its entirety." U.S. V. Boula, 997 F.2d
263, 266 (7th Cir. 1993) ; U.S. V. Anderson, 61 F.3d 1290, 1301 (7th
Cir. 1995). In this particular case, based on Judge Zagel's
uncontested finding of fact in his April 13, 1998 J and C Order that
the two (2) guideline offenses (racketeering and narcotics
conspiracies) ended on March 9, 1989, the 1988 Revised Edition
version of the Guidelines Manual was effective law at that time
and must therefore be used in its entirety. In this particular
case, based on the Guidelines Manual's Appendix A - Statutory
Index, only guideline Section 2A2. (a) is the proper applicable
guideline for violations of 18 U.S.C. 1952A. Robinson's charged
underlying racketeering activity" for the racketeering count (a
charged violation of 18 U.S.C. 1962, 1963), supported by the
government's indictment, initial trial and retrial evidence, was
conspiracy or solicitation to commit murder," not "first degree
murder!" Guideline Section 2E1.4 is the most applicable guideline
for the racketeering statute violation.
2 - The prosecuting Assistant U.S. Attorneys (Victoria J.
Peters, Matthew M. Schneider) in this case declared in the
Government's Amended Version Of The Offense dated September 15, 1997,
a PSI Report supplement, that "the most applicable guideline for
[Noah's charged] underlying racketeering activity" is guideline
Section 2A2.1(a), the solicitation and conspiracy to murder
guideline. Barber was murdered. Noah did not kill him. Section
2A2. (a) reflected Noah's charged role in the Barber offense,
according to the government's evidence. See, Exhibit J.
The prosecuting attorneys' assessment of the most applicable
guideline for Noah Robinson's role in the Barber offense, Section
2A1.1(a), is at odds with the U.S. Probation Office's assessment
of the most applicable guideline, Section 2A1. (a). Please note
that in the federal criminal justice system, it is the government
prosecutor who has - over any judge or probation officer- - the
exclusive charging authority, and their charging assessments must
be given deference.
3 - Appendix A - Statutory Index of each and every version of
the Guidelines Manual specifies the guideline section or sections
ordinarily applicable to the statute of conviction. In the 1988
Revised Edition of the Guidelines Manual - the Guidelines Manual
in effect when Judge Zagel ruled that the RICO conspiracy offense
ended - the guideline section(s) applicable to 18 U.S.C. 1952A and
