As you may know, the federal housing preference for the homeless was enacted by Congress several years ago and was repealed with the recent passage of the rescission bill. The Department of Housing and Urban Development (HUD) has advocated this change for the past two years and strongly believes that preferences for housing should reflect local needs. I have asked the staff of HUD to investigate the serious concerns you raised about the Section 8 applications submitted by Mr. Caesar Fievet and Mr. Jesus Lopez. Based on a preliminary review, it appears that only two bedroom apartments are currently available at Manhattan PLaza. Current HUD guidelines suggest that no more than two individuals share a bedroom in order to avoid overcrowding. The rejection of Mr. Lopez's Section 8 application on the basis that his son and daughter could not share the same bedroom was not a result of any HUD regulation or rule. HUD regulations and rules do not restrict the gender of occupants of the same bedroom.
