Washington, D.C. 20500 Dear John. where 0~ᵈ Tol I am writing to alert you to several provisions contained in S. 2962, a bill recently amended and ordered reported by the Senate Committee on Environment and Public Works, because they may become part of the budget end-game. One provision, in particular, threatens, without basis, to substantially re-write Clean Air Act authority pertaining to vehicles. As you may be aware, there are numerous legislative proposals in both the House and Senate intended TO address the issue of methyl tertiary butyl ether (MTBE) contamination resulting, in large part, from leaking underground storage tanks S. 2962, entitled the "Federal Reformulated Fuels Act of 2000," is intended to significantly amend the Clean Air Act to effectuate a phaseout of MTBE. I note that most observers, including Chairman Smith, admit that it is unlikely the bill will reach the Senate floor. ! anticipate that an effort will therefore be made to include this measure in a spending bill at the end of this Congressional session. Although I have several reservations about S. 2962 as reported, 1 am very troubled by a provision that, perhaps unbeknownst to the authors, may re-open decades of debate on the statutory framework for motor vehicle emissions standards. This provision, contained in section 9 of S 2962, would require the Environmental Protection Agency (EPA) Administrator to publish proposed regulations establishing performance requirements for motor vehicles. Of the many bills introduced in the House and Senate on this issue, no bill has contained such a provision. This is likely because there is no evidence that motor vehicles or motor vehicle emissions are the cause for MTBE contamination in groundwater. Moreover, no such provision has been the subject of review during a legislative hearing on this issue.
