RESOLUTION 98-10-08-02
A RESOLUTION OPPOSING A MORATORIUM ON FEDERAL MANAGMENT
OF SUBSISTENCE
WHEREAS. The Native Village of Koyuk is a federally recognized tribal government
body for the community of Koyuk, in the Bering Straits Region of Alaska; and
WHEREAS. the United States government is mandated by ANILCA and the federal
government courts to assume management on subsistence fishing in federally- controlled
waters in Alaska on December I, 1998 because the State of Alaska is not in compliance
with the subsistence protections in ANILCA; and
WHEREAS. the State of Alaska has had eight years to come into compliance with
ANILCA and has shown by the inaction of its legislature that does not have the political
will to protect subsistence in accordance with ANILCA: and
WHEREAS, Alaska state fish and game laws do not provide a meaningful protection
to people reliant on subsistence USCS of fish and game; and
WHEREAS. the federal government has managed subsistence hunting on federal
lands since 1991 but has been prevented from managing subsistence fishing by "
moratorium" rides to federal appropriation acts which the Alaska Congressional
delegation has obtained in the hope of persuading the Alaska state government to come
into compliance with ANILCA; and
WHEREAS, any further moratorium or extension of time for the state to act will just
encourage the state politicians who oppose any meaningful protection of subsistence and
delay indefinitely resolution of the subsistence impasse in Alaska;
