Since 1 am about to pack boxes, I suggest that James and Nancy to have a chat and think about
timing and process for resolving two difficult issues:
1.
One question of particular substantive and political import: the effect of Adarand on
programs for HBCUs and Minority-Serving Institutions. We can all rehearse the favorable and
unfavorable arguments with only a few moments of thought. (Is this targeting or is it exclusion
of "historically white" institutions; the aid goes to open institutions, not to individuals.) My
main concern is that we try to get comparatively early closure on the governing doctrinal
framework, so that everyone be on the same page as the questions start streaming in and the
empirical projects are designed.
2.
Although gender preferences are not at immediate issue, both the President's policy
framework and common tactical prudence suggest that some modified form of the
Adarand/Dellinger assignment be carried out for gender-based programs. Our consultations
with the groups bear this out. What division of labor is nceded to prepare strong analyses and
defenses of these programs?
