Secakuku CHAIRMAN July 30, 1997 Wayne Taylor, Jr. VICE-CHAIRMAN The Honorable Ted Stevens, Chairman Senate Committee on Appropriations United States Senate 522 Senate Hart Building Washington, D.C. 20510 RE: Provisions in FY-1998 Appropriations Bill H.R. 2107 for Department of the Interior: Sections 112, 118; 120, 310, and Title I-General -- Endangered Species Act in Relation to Indian Tribal Lands Dear Chairman Stevens: As Chairman of the Hopi Tribe, I seek your support in opposing Sections 112, 118, 120, 310, and Title I General-ESA Secretarial Order language under Fish and Wildlife and Parks. These are extremely troublesome provisions to the FY 1998 Interior and Related Agencies Appropriations Bill. Sec. 112. Limitation on Advance Payments to Indian Tribes The existing requirements governing the investment of federal dollars by a Tribe under Self-Governance compacts and P.L. 93-638 contract requirements has proven to have been carried out under prudent fiscal management. Limitations such as those cited under Sec. 112 are unnecessary and are imposed on tribes without sufficient justification, further complicating a process which had otherwise been streamlined to provide greater efficiencies in the management and accountability of federal funds. Sec. 118. Needs Based Funding Distribution (Means Testing) for TPA Funds We strongly oppose Sec. 118 which will impose needs based funding (means testing) of tribal governments. Such an approach would penalize economically successful tribes, which would receive significantly fewer federal funds. State and local governments are not penalized by the federal government for achieving economic success. To the contrary, the allocation of federal funds to state and local governments almost never depend on how much money each state has earned through its various economic ventures. Is Congress going to impose this funding formula on the States and their local governments? We have only sought fairness in dealing with the Federal Government, states and local governments.
